RBE No. 18/2006: Cadre Restructuring – Proforma Fixation

Sub: Cadre restructuring of certain Group – C & D cadres – Grant of proforma fixation.
Ref: Railway Board’s letter No.PC-III/2003/CRC/6, dated 09.10.2003 (RBE No. 177/2003) and No.PC-III/2004/CRC/3, dated 03.06.2004 (RBE No.114/2004).

1. The instructions were issued regarding Cadre Restructuring of certain Group ‘C’ and ‘D’ cadres vide Board’s letter No.PC-III/2003/CRC/6, dated 09.10.2003 (RBE No. 177/2003) as further modified/ clarified from time to time. As per these orders, the normal vacancies existing as on 01.11.2003 (except direct recruitment quota) and those arising on the date from the cadre restructuring (including chain/ resultant vacancies) were filled up through modified selection procedure and the selections for normal vacancies existing on 01.11.2003 for which panels were not finalized by 05.01.2004 were cancelled/abandoned. While those promoted against restructuring vacancies were eligible for fixation of pay benefits from the cutoff date, the candidates promoted against the normal vacancies existing prior to restructuring were to get benefit only prospectively. Demands have been made by the federations for grant of pay fixation benefits in favour of staff promoted against normal vacancies also from the cutoff date stating that the ongoing selections were cancelled due to implementation of the above order and period consumed in actual implementation of restructuring resulted in delayed filling up of such normal vacancies.
2. The demand has been considered by the Ministry of Railways (Railway Board) in consultation with the Federations and it has been decided, as a special dispensation to settle staff side demand, that proforma fixation of pay from 01.11.2003, with actual payments from the date of actually taking charge of the higher grade post, may be allowed in favour of those promoted against the normal vacancies existing on the above date, viz. 01.11.2003 subject to the following stipulations:-

(i) The benefit would be available only to those who was selected and actually posted against the existing vacancies. This will not be made available to those who had already retired/ resigned/ vol. retired/ expired/ quit service, etc. and did not physically take charge of the higher grade post, as also to those promoted against anticipated vacancies occurring on or after 02.11.2003.
(ii) The concerned person should be fit and eligible in all respect as on 01.11.2003 for promotion against existing vacancy and it should be certified by the cadre controlling authority duly vetted by Associate Finance that delay has actually occurred in promotion against existing normal vacancy purely due to the late implementation of the restructuring.
(iii) Notional fixation of pay as above (without payment of any arrears) would not be reckoned for calculation of retirement benefits nor for seniority or and any other additional benefit.
(iv) Vacancies arising from 02.11.2003 onwards and filled up subsequently bill continue to be governed by existing provisions regarding prospective pay fixation benefits and there will be no chain effect of the above notional benefit down the line.
(v) As it is a special dispensation to settle the staff side demand in JCM/DC and PNM on this issue, it MUST not be construed as a precedent for any other cases arising in future either out of restructuring or otherwise.

3. This issues in consultation with Establishment Directorate and with the concurrence of Finance Directorate of Ministry of Railways.
