In continuation of instructions contained in Board’s letter No.E(NG)I/90/PM1/11, dated 09.05.1991 (RBE No.100/1991) on the above subject, please find enclosed a copy of the Office Memorandum No.16/7/90-Estt.(Pay-I), dated 20.03.1995 received from the Deptt. of Personnel and Training, M/O Personnel, P.G. and Pensions for information and necessary action. OFFICE MEMORANDUM

Sub:   Time limit for relieving an official consequent upon his promotion to the higher grade.

1. The undersigned is directed to say that as a result of decision on the demand of the Staff Side in the National Council (JCM), orders were issued under this Department’s OM of even number dated the 9th September, 1992 to the effect that Government servants ordered for promotion should be relieved immediately on receipt of the relevant order of promotion and that in exceptional circumstances where the retention of the official in the lower post is felt absolutely necessary in exigencies of services, the fact may be brought to the notice of the Controlling Officer and orders sought for retention for a specific period ranging from one to three months depending on merits of each case. While doing so it has to be specifically brought to the notice of the Controlling Officer that delay in relieving the officer will cause him pecuniary loss, so the retention may be avoided as far as possible. It has however been brought to the notice of the Government that even after issue of formal orders of promotion, on one pretext or the other, the promoted officials are not relieved of their duties from the lower post even within the period stipulated above, causing avoidable monetary loss to them.

2. The matter has been raised again by the Staff Side in the National Council (JCM) and it has been decided to reiterate these instructions. It has also been decided to fix responsibility on Controlling Authority for relieving of the Government Servant within the period of three months in any case. All the Ministries/ Departments etc. are requested to bring these instructions to the notice of all concerned for their guidance and strict compliance.
