Voluntary Retirement: RBE No.56/2026 – Amendment to Rule 1802 (b)(1), 1803(b)(1) & 1804(b)

Sub: Amendment in the provisions of Voluntary retirement under Rules 1802 (b)(1), 1803(b)(1) & 1804(b).
1. DoP&T has revisited the provisions of Fundamental Rule 56(k), 56(m) and Rule 48 of CCS (Pension) Rules, 1972 relating to acceptance of request of voluntary retirement as per the Central Administrative Tribunal, Principal Bench’s judgment dated 04th August, 2010 in O.A. No.1600/2009 filed by Shri Gopal Singh Purohit Vs UOI & Others to bring them at par with each other. In this context, DOP&T in consultation with DOP&PW and M/o Law have amended the Fundamental Rules 56(k) and 56(m) vide Extraordinary Gazette Notification No. GSR. 27(E) dated 17.01.2014.
2. The matter has been examined in Board’s Office and it has been decided that it shall be open to the Appropriate Authority to withhold permission to a railway servant, who seeks to retire under Rules 1802(b)(1), 1803(b)(1) & 1804(b) in the following circumstances:
(i) If the railway servant is under suspension; or
(ii) If a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) If judicial proceedings on charges which may amount to grave misconduct, are pending.
Explanation:- For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceeding.
3. This order shall take effect from 17.01.2014. The past cases decided in terms of existing provisions need not be reopened.
4. The provisions in respect of Retirement Rules are contained in Chapter-18 of Indian Railway Establishment Code (IREC), Volume-II, 1987 Edition (Reprint Edition-2005). In view of this, in exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President is pleased to direct that Retirement Rules may be amended as per enclosed Advance Correction Slip No.65.
5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Advance Correction Slip No.65
The following amendments may be made to Retirement Rules contained in Chapter-18 of the Indian Railway Establishment Code, Volume-II, 1987 Edition (Reprint Edition -2005):-
The proviso to the clause (b) (1), shall be substituted as under:-
“Provided that it shall be open to the Appropriate Authority to withhold permission to a railway servant, who seeks to retire under this clause, if, –
(i) the railway servant is under suspension; or
(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.
Explanation:- For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceeding.”
The proviso to the clause (b) (1), shall be substituted as under:-
“Provided that it shall be open to the Appropriate Authority to withhold permission to a railway servant, who seeks to retire under this clause, if, –
(i) the railway servant is under suspension; or
(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.
Explanation:- For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceeding.”
The clause (b), shall be substituted as under:-
“(b) A railway servant in Group ‘C’ post who is not governed by any pension rules, may, by giving notice of not less than three months in writing to the Appropriate Authority, retire from service after he has completed thirty years service.
Provided that it shall be open to the Appropriate Authority to withhold permission to Government servant, who seeks to retire under this clause, if, –
(i) the railway servant is under suspension; or
(ii) a charge sheet has been issued and the disciplinary proceedings are pending; or
(iii) if judicial proceedings on charges which may amount to grave misconduct, are pending.
Explanation:- For the purpose of this clause, judicial proceedings shall be deemed to be pending, if a complaint or report of a police officer, of which the Magistrate takes cognizance, has been made or filed in a criminal proceeding.”
