Family Pension: RBE No.203/2000 – Cases of More Than 1 Family Pension

Sub: Revision of family pension of pre-86 family pensioners who are in receipt of more than one family pension.
An instance of a pre-1986 family pensioner in receipt of two family pensions viz. one under Liberalised Pensiòn Rules, 1950 and the other under Extraordinary Family Pension has been brought to the notice of Board when the question of revision of the same under Board’s letter No.F(E)III/97/PN/1/23, dated 07.11.1997 (RBE No.143/1997) and F(E)III/98/PN 1/2, dated 10.03.1998 (RBE No.55/1998) came up. The matter has been considered in consultation with DOP&PW and it is clarified that a family pensioner cannot draw two family pensions in respect of one deceased Railway servant as Rule 55 of the CCS (Pension) Rules, 1972 regarding Liberalised Family Pension, 1950 was deleted vide Government of India Notification dated 20.07.1988 and family pension in all such cases is to be considered under Rule 54 of CCS (Pension) Rules, 1972 corresponding to Rule 75 of Railway Services (Pension) Rules, 1993. In view of this, cases of family pensioners, if any, who are in receipt of more than one family pension in respect of same deceased Railway servant may be considered for sanction of single family pension under Rule 75 of Railway Services (Pension) Rules, 1993.
