RBE No. 98/2008: Family Pension – Divorced/ Widowed Daughter

Sub: Eligibility of divorced/ widowed daughter for grant of family pension – Clarification regarding.

Instructions were issued vide Board’s letters No.F(E)III/98/PN1/4, dated 16.03.2005 (RBE No. 44/2005) and 13.10.2006 (RBE No. 152/2006) extending the scope of family pension to widowed/ divorced daughter beyond 25 years of age subject to fulfillment of all other conditions prescribed in the case of son/daughter. A few references have been received from different Railways seeking clarification on certain issues related to these instructions, which have been examined in consultation with Department of Pension and Pensioners’ Welfare and it is clarified as under:-

Whether a daughter who is divorced/ attains widowhood at any age is eligible for family pension (e.g. at the age of 60, 70…)?

Yes; a widowed/ divorced daughter shall be eligible for family pension irrespective of her age at the time of becoming widow/ divorcee subject to fulfillment of certain conditions, including the income criterion, as stipulated in the relevant provisions of Railway Services (Pension) Rules, 1993 and the orders issued thereunder.

(ii)

Whether the divorced/ widowed daughter is eligible for family pension even after the cessation of pension/ family pension to the employee/ widow/ dependents (when all the members of the family cease to draw family pension and there is a gap of one or more years).

Yes; Divorced/ widowed daughter will be eligible for family pension after the cessation of pension/ family pension to the employee/ widow. The orders shall, however, apply prospectively as and when such a contingency happens.

(iii)

Whether the divorced/ widowed daughter is eligible for family pension even when she has children who are gainfully employed.

Yes; The criteria as provided in the rule is that the income of the divorced/ widowed daughter should not exceed Rs.2550 p.m. from employment in the govt., the private sector, self employment, etc. The main consideration here is whether she is earning more than Rs.2550 p.m. or not.

(iv)

How the claim of an elder daughter becoming widow or getting divorced while her younger widowed/ divorced sister is already in receipt of family pension, is to be regulated?

In such a situation the younger widowed/ divorced daughter may continue to draw the family pension for life. The elder widowed/ divorced daughter would get the family pension only after the younger daughter who is in receipt of family pension, becomes ineligible by way of death/ income criteria etc. as provided in the Rules.

    Divorced sister getting railway pass as a dependent , is she entitled to get railway pension when her railway pension holder mother expired.

    My late father was from the Indian Railway Traffuc Service my mother is no more ,
    I am the divorced daughter.
    I get the family pension .
    Please advise how can I get the railway medic facility and the railway pass ..

      I am advocate . Contact No 9991928862 , E-mail address – jaikisc@gmail.com for getting Family Pension. For widowed/divorced daughter no fee required earlier. Advocacy fee required after the starting your pension which will be decided when take up your case.

      yes if you divorce Applied or completed before death of your parents. you can go where your father retire last. they will give you application format for applying pension. mainly divison office setelment section will help you in this case.

        I am divorced daughter and I am helpless please give advise to claim pension from the N F Railway hard quarter.My name is Anumita Sinha.My mother is no more. My father is still alive but he is not submitting the papers and .His age is 79 years old .All procedure from the family court had been completed. At present I have no source of income.

    I am a divorce. I separated from my husband in 1998 and my husband issued notice in 1998. My father took many steps for the rejoin/reunion with my husband but all them have become futile and failed . ultimately I stayed in my parental house till the death of my father in 1999. My husband filed the petition for divorce in 2012 BEFORE THE COURT and DIVORCE DECREE was issued in 2015. Subsequently my husband also died. I have no knowledge of the claim of pension of my father till November 30th of 2021.
    Today one of the Lawyer who came to my village advised me to apply for my fathers pension.
    In the above circumstances whether I can get pension of my father who was employed in RAILWAYS leaving me as a divorce and also widow.

      Yes you can apply for family pension as divorced daughter at yours railway office..(*only if your father has put your name on medical or railways pass documents or any railway documents as dependent*) to get further more information ask at your father’s working office..please take your divorced certificate before going to office.

      Good Morning.
      A divorce petition was filed before death of patents.I got divorce after death of parents.Kindly help me to quote Rly Board’s circular which reads for family pension in my case.
      I am helpless and struggling with one dependent daughter also.Nobody is ready to help me.Please help me.

    My father was a railway employee and he is no more my mother is alive and family Pension holder. I am widow I am eligible for family Pension of my father? If eligible how can I apply for this? And what documents are required?

    My father was an employee of eastern railway and both my parents are no more.
    I was lost my husband on 2007 after that I got remarried August 2017, and then mutually seperated with that person on 2022. My was died on Nov 2020 and drawing family pension from eastern railway.

    Now shall I elegible for railway family pension?
