Sub: Relieving of staff on Transfer on Mutual Exchange Basis.
1. Instructions were issued vide Board’s letter of even number dated 15.09.2017 (RBE No.130/2017) advising Zonal Railways and Production Units to spare staff awaiting mutual transfer where the requests had been accepted by both the Railways/Production Units. Detailed guidelines were subsequently issued under Board’s letter of even number dated 22.09.2017 (RBE No.131/2017) regulating the process of mutual transfer stipulating time limit for each step involved therein.
2. In partial modification of instructions contained in Board’s letter No.ERP/Portal-Transfer/2013 dated 30.04.2014 stipulating that once the mutual transfer order is issued the senior person should be relieved first, it has now been decided by the CRB that all mutual transfer cases where NOC has been given by both the Railways/Units i.e. accepting and relieving, both the employees should be spared immediately within a week, without either unit waiting for the reliever.
3. A photocopy of Service Record and un-vetted LPC should be given to the employee for submission at the new Division. Original Service Records/LPC also be sent positively within 15 days.

As per Rule 310 ‘Mutual Transfer contained in Indian railway Establishment Manual, Vol-I Railway servants transferred on mutual exchange from one cadre of a division to the corresponding cadre in another division.’
MACP is mere financial up-gradation of a stagnated railway employee, personnel to him. Because of MACP, status remains same in the cadre. In mutual transfer Senior Railway Servant will acquire the seniority of his counterpart.
To maintain balance in the post based rosters, mutual transfers are accepted in the same category i.e. SC/ST/OBC/GEN. Your case need to be materialized on the same lines.

Please refer Para 149 of IREM. As per this Para eligibility criteria for 33-1/3% DR quota to the post of ESM-II is (a) A pass in 1st year of B.Sc. (Physics) or (b) A pass in 10+2 stage in Higher Secondary in Science i.e. Maths or Physics or equivalent. Since both of you are DR in Gr-II you might be fulfilling above criteria, and no separate qualification is prescribed for EMS Gr-I.

In your previous comments you have mentioned that in mutual transfer both the candidates have to be from same category…but in case of initial posting what is the criteria? And if there is no such criteria then is it true that NWR zone is following it…whereas in initial posting you can do mutual transfer with any category.

System evolved on the Railways is to comply Roster points in direct recruitment as well as in promotional categories as per the judgment of the Supreme Court in the case of R.k.Sabharwal vs State Of Punjab and accordingly RBE No.113/1997 & 114/1997 dated 21.08.1997 were issued. 8 साल के बाद 4200 ग्रेड-पे से 1900 में जाने के लिए कहना उचित नहीं है, जैसा कि जबलपुर अधिकरण ने पारत निर्णय में माना है।
म्यूच्यूअल के नियम अनुसार वरिष्ठ कर्मचारी को कनिष्ठ कर्मचारी की वरिष्ठता प्राप्त होती है।

Mutual of ST with GEN is not permissible as it will disturb reservation roster in both the cadres. If otherwise eligible for mutual transfer, fresh application is to be moved in case of promotion to the higher grade.

Since before issuance of mutual transfer orders, you have been promoted, now mutual transfer orders should not be issued.
Basic pay does not change in Mutual Transfer it is only ‘Seniority’ which gets affected.

Quota is earmarked for direct recruits and promotees in Tech-III. Mutual between from two separate streams will create imbalance in the prescribed quota, as such mutual should not be permitted.

As per para 10.1 of Board’s letter dated 10.09.2003 (RBE No. 177/2003) http://railwayrule.com/rbe-no-177-2003-restructuring-group-c-d-cadres cadres of SM/ASM + YM + TI have been merged into one unified cadre of SM/ASM. Accordingly, mutual in your case may be permitted provided all other conditions of mutual transfer are fulfilled.

Or bottom seniority pe humari basic change hogi ya wohi rahegi plz sujjest me .

Mutual transfer application deigination keyman se lagate hai to dono karmchariyo ko same deigination keyman milega ya nahi. level 2 GP 1900 application lagane ke Baad dono karmchariyo ka promotion level 4 GP 2400 deigination keyman hi hai.to level & GP kya rahega.

Please see Para 4(iv) of Railway Board Circular RBE No.08/2019 on https://railwayrule.com/rbe-no-08-2019-mutual-transfer-comprehensive-policy which says that backtracking from mutual transfer is not permissible.
