Sub: Promotion of non-gazetted staff to selection posts – Assessment of fitness for.
1.As the Railway Administration etc. are aware, for promotion of non-gazetted staff to posts classified as selection, fitness as assessed under the following heading as provided in para 219(g) of IREM, Volume-I, 1989.

2. The question of making the assessment under the heading Personality, Address, Leadership and Academic/ Technical qualifications more objective, has been under the consideration of this Ministry inter alia in view of the findings of the CAT/ Ernakulam Bench in the combined judgment dated 03.10.1994 in OA Nos.59/1991, 1048/1991, 1843/1991 and 1100/1992, concluding that in cases where selection is based only on viva voce earmarking 70% of marks under the headings Professional Ability and Personality, Leadership, Address and Qualification is arbitrary and subjective. In the said judgment The Tribunal has also observed that a cue can be taken from the Supreme Court judgments in Airlines Corporation v. Shukla 1993(1) SCC 17 and Ansar Ahmed v. State of Bihar AIR 1994 SC 141, holding 50% marks for Record of Service and remaining 50% of the marks for viva-voce as reasonable.
3. It has now been decided that the assessment for promotion to selection posts under the heading Personality, Address, Leadership and Academic/ Technical qualifications should be based on the assessment already available in the Confidential Reports of the concerned employee, wherever maintained, as reflected by entries against various columns in the formats in the form of Annexures I to IV circulated to the Railway etc. in Board’s letters No.E(NG)I-86/CR/5, dated 22.04.1987 (RBE No. 83/1987) and No.E(NG)I-86/CR/4, dated 23.02.1988 (RBE No. 32/1988). The various Annexures and the columns, entries against which have to be taken into account are indicated below in juxtaposition.

4. Wherever applicable, the assessment made in Section II of Confidential Report format in respect of staff in grade Rs.1600-2660/ 5000-8000 and above who are likely to be considered for promotion to Group ‘B’, covered by Annexure I to IV circulated vide this Ministry’s letter No.E(NG)I-86/CR/4, dated 23.02.1988 (RBE No. 32/1988) may also be taken into account for the purpose of awarding marks under the heading Personality, Address, Leadership and Qualifications.
