Sub:   Consolidated instructions on Railway travel facilities extended to Members of Parliament.

OFFICE MEMORANDUM

Instances have come to notice where the extant instructions in regard to rail travel facilities extended to Members are not being followed resulting in great inconvenience to the Members while on travel. It is therefore considered necessary to reiterate the same to the Railway Administrations and also advise the Members to avoid any embarrassing situation. For ready reference, the same are incorporated in the annexure. It is requested that the, Ministry of Parliamentary Affairs may please take necessary action to suitably convey the same to the Members for their kind information and strict observance.

ANNEXURE

(1)   Members of Parliament are entitled to travel in I Class at any time by any Railway in India, accompanied by one person in First Class, on the authority of the Identity Card-cum-Railway Pass issued to him.

(2)   In addition, Spouse of Member is entitled to travel in First Class on the authority of the spouse pass from the usual place of residence of the Member to Delhi and back once during every session. “Once during every session” has been clarified as the period beginning after the issue of Summons for a particular session of the House and ending 4 weeks after the termination of that session of the House.

(3)   In respect of the items 1 and 2 above namely travel by MPs, Spouses and Companions, they are permitted to travel by A/C II Tier by any train including Rajdhani Expresses without payment of any difference in fare or surcharge.

(4)   (a)   When an MP wishes to travel by A/C Class and is accompanied by one person in First Class, he will pay the full difference between the railway fare for the I Class A/C and I Class.

(b)   If he is not accompanied by one person in I Class, the Member will be required to pay only the difference between I Class fare and A/C Class, further reduced by one I Class fare. In this case, journey form as provided under the rules has invariably to be surrendered at the time of reservation indicating that the Member is not accompanied by one person in I Class. This form will enable the Railway concerned to account for the same while raising debits against Lok Sabha/ Rajya Sabha Secretariats.

(c)    In cases where I ACC fare is more than 2 single First Class fares, a Member is required to pay the difference still left.

(d)   In cases where I ACC fare is less than 2 single First Class fares, a Member shall not be entitled to claim the balance left after such adjustment.

(5)   In regard to travel of companion/ spouse of a Member, journey forms are required to be surrendered at the detraining stations. This will enable the Zonal Railway Administrations to similarly account for the same while raising lumpsum debits for such travel against Lok Sabha/ Rajya Sabha Secretariats.

(6)   While travelling, a Member is required to keep the Identity Card-cum-Railway Pass for checking by the Ticket Checking Staff on duty. Similarly the Spouse Pass should be available with the spouse.

(7)   In respect of travel by Spouse/ Companion of Members in Superfast Express Trains, they are not required to pay surcharge. However, instructions have been issued to Zonal Railway Administrations to include such surcharge in the amount of fare while raising lumpsum debits against the respective Secretariats. The fact of having travelled by Superfast Express Trains should, however, be indicated in the Railway Journey Forms surrendered at the detraining stations so that there is no omission in raising debit of this amount together with the fare.

(8)   No person can travel free by rail as a companion of an M.P. unless the M.P. concerned is himself also travelling in the same train.
