Sub:  Central Govt. Employees Group Insurance Scheme, 1980 – Clarification regarding.

Reference is invited to Board’s letter of even number dated 25.03.1983 read with clarifications issued under letter of 29.08.1983. A copy of Ministry of Finance, Department of Expenditure’s O.M. No.7(2)-EV/86, dated 07.10.1987 on the above subject is forwarded herewith for information and necessary action. These provisions mutatis mutandis will equally apply to Railway Employees governed by the Group Insurance Scheme.

OFFICE MEMORANDUM

Sub: Central Goyt. Employees Group Insurance Scheme, 1980 – Clarification regarding.

1. The undersigned is directed to invite the attention of Ministries/ Deptts. etc., of the Central Govt. to para 11.2 of the Central Govt. Employees Group Insurance Scheme, 1980 wherein it has been provided that in the event of death of a member of the Scheme the insurance amount and the accumulations in the Savings Fund are to be paid by the Head of Office to the nominees/ heirs of the deceased Govt. servant. Para 19.3 of the Group Insurance Scheme, 1980 requires that if a member of the Scheme has a family he shall make such  nomination only in favour of a member or members of his/her family. Keeping in view these provisions instructions were issued under this Ministry’s O.M. No.15(3)78-WIP, dated 3rd March, 1983 to regulate payments when an employee makes no nomination or the nomination made by him/her is not valid.

2. The Staff Side of the National Council (JCM) have demanded that:-

(i) In the absence of a nomination, a certificate from the Head of the Deptt. duly witnessed  by two or three Govt. employees may be accepted in lieu of succession certificate.

(ii) In the absence of nomination under this Scheme any nomination made for post-retirement benefits may hold good for receiving insurance money.

(iii) Exclusion of sons who have attained majority and married daughters from the family is harsh as there is no reason why the insurance amount should lapse to Govt.

3. The matter was considered in a meeting of the Committee of National Council (JCM) held on 23rd April, 1986. In the light of the discussions, the following decisions have been taken: 

(i) In the absence of a valid nomination under Group Insurance Scheme, the nomination, if made under the GPF/CPF Rules, may be accepted for the purpose of the Group Insurance Scheme also.

(ii) Where there was no nomination even for GPF/CPF, the amount payable under the Insurance Scheme may be paid as follows:

(a) The entire amount may be paid in equal/ shares to widow/ widows, minor sons and unmarried daughters provided that in the case of more than one widow the second and subsequent marriages were solemnised with the permission of Central Govt. In the case of minor sons and daughters, their mother shall be deemed to be the natural guardian to receive the amount due.

(b) In the absence of members eligible under (a)  above, the payment may be made in equal shares to other members of the ‘family’ as defined in GPF/CPF Rules.

(c) If there is no one eligible under (b) above also, payment may be made to other legal heir(s) not covered by the above items (a) & (b) above.

4. In respect of cases covered by items (a) & (b) above, the payment may be made by the Head of Office without insisting on production of a succession Certificate. But in the event of payment under item (c) above, Succession Certificate issued by a competent court has to be produced.

5. In order to avoid the difficulty in making payments in the absence of nominations Ministries/ Deptts. are requested to re-check and obtain nominations from all the Govt. employees.

6. These orders will also apply to all cases which have not been settled so far, i.e. where payments have not actually been made.

7. In its application to the employees serving in the Indian Audit Accounts Department this office Memorandum issues in consultation with the Comptroller & Auditor General of India.
