Overtime: RBE No.50/1988 – Gangmen

Sub: Claim of overtime for 1/2 hour daily by Gangmen for the period from 01.08.1974 to 01.05.1978.

In a meeting of the Departmental Council for Railways under JCM held on 27.04.1979, it was decided that the Gangmen in the Civil Engineering Department would be employed on daily roster of 8 hours and that the extra time of 30 minutes for attending to preparatory and/or complementary work will not be added to their daily roster. It was also agreed that the work content of Gangmen will not be reduced. This decision was given effect from 01.05.1979 (being new decision).

The Gang Staff under P.W.Is. on a particular Railway filed Writ Petition claiming overtime allowance for half an hour daily for the period from 01.08.1974 (the date of implementation of the recommendations of RLT, 1969) to 01.05.1979, the date of above decision.

The decision taken by the Ministry as contained in their Wire No.E(LL) 78/HER (RLT)-15, dated 27.04.1979 was a fresh decision taken after detailed discussions in the Departmental Council meeting and it was explicitly provided that this decision would be given effect from 01.05.1979.

Board desire that if same/ similar issue is taken up through legal process or otherwise by Gang staff on your Railway, the matter should be brought to their notice immediately and further instructions sought from them.
