Stagnation Increment: RBE No.04/1989 – Clarifications

Sub: Grant of ad hoc increment to employees stagnating at the maximum of their pay scale – clarifications regarding.

Reference this Ministry’s letter of even number dated 13.08.1987 (RBE No.201/1987) on the above subject. The Ministry of Finance have clarified various points raised by certain Ministries Departments, with reference to the above order. These are given below for your information and guidance:

 Points of doubtClarification
1Whether stagnation increment will be taken into account for the purpose of fixation of pay on promotion to higher post.No. However, if pay fixed in the higher post under normal rules happens to be less than the pay plus stagnation increment(s) in the lower post, the difference may be allowed as ‘Personal Pay’ to be absorbed in future increases in pay.
2Whether the period of officiation in the higher post on ad hoc basis will be taken into account for counting the two years stagnation at the maximum of the scale of the lower post and on reversion the employee will be granted the benefit of stagnation increment if the period of stagnation is 2 years or more.Yes.
3Whether the period of 2 years will count from the date the employee reaches the maximum of the scale after the grant of last increment or one year thereafter.The period of 2 years will count from the date the employee reaches the maximum of the scale after the grant of last increment.
4Whether the benefit of stagnation increment(s) will be admissible to the employees in the pre-revised non-functional selection grade allowed revised scales on personal basis.Yes.
5Whether the benefit or stagnation increment(s) will be admissible in case of ex-cadre post held on deputation basis.(a) In case the employee has opted for grade any plus deputation (duty) allowance, the benefit of stagnation increment will be admissible in the scale of the cadre post subject to fulfillment of all other conditions. Deputation (duty) allowance will be determined with reference to the basic pay alone and stagnation increments will not be taken into account for this purpose.
  (b) In case the employee has opted for the scale of deputation post, the stagnation increment(s) will also be admissible in the scale subject to fulfillment of all other conditions.
6How the stagnation increment(s) will be regulated in cases where disciplinary cases are pending against the Government servant?On the conclusion of the disciplinary proceedings, stagnation increment(s) may be regulated like annual increment viz. with reference to the findings of the enquiry and orders of the disciplinary authority therein.
