Sub: Reservation order for Scheduled Castes and Scheduled Tribes – application of – to vacancies or posts – Supreme Court’s interim order dated 21.12.1984 CMP Girdharilal Kohii and others vs. Union of India and Others.

Ref: Your Railway’s letter No.P(Res.)171/PNM/Sangh, dated 06.10.1988.

In this connection reference is invited to the instructions contained in Board’s letter No.85-E(SCT)/49/2, dated 26.02.1985 (RBE No.58/1985) regarding the procedure for implementation of the Supreme Court interim order dated 21.12.1984 wherein inter alia it has been stated as under:

The question of carry forward or exchange of posts between SCs/ STs Communities should not arise since the orders of the Supreme Court are being implemented only in relation to the restructuring scheme covered by Board’s letter No.PC-III/84/UPG/9, dated 16.11.1984.

It is observed that filling up of the additional vacancies arising out of implementation of Board’s re-structuring order dated 16.11.1984 without the aid of roster system and on the basis of the number of posts in the Cadre was only a one time exception to comply with Supreme Court’s interim orders. Once the vacancies arising out of re-structuring orders have been filled up, the normal practice of filling up the vacancies that would arise in the normal course would, have to be resorted to through the roster system except in case of categories of posts in some of the Railways where the CATs/ High Courts interim orders/ judgments are operative.

In view of the position stated above it is considered that the backlog which existed prior to 31.12.1983 should be carried forward after implementation of re-structuring orders w.e.f. 01.01.1984 to the subsequent filling up of vacancies as mentioned in your letter quoted above.
