RBE No. 82/2006: Act Apprentices – Registration of Contract

Sub: Registration of the Contract

It has been observed that some of the Railways are not following the procedure for engagement of Act Apprentices for training purposes as entailed in the Apprentices Act, 1961.

Your attention is drawn to Board’s letter of even number dated 18.07.2005 N.T. and No.E(MPP)95/6/13, dated 21.08.1995 directing the Railways to transmit the contracts of apprenticeship for registration to the Apprenticeship Advisers/ RDATs within a period of 3 months. It is desired that whichever unit is organizing training for the Act Apprentices, they may be asked to get the latest copy of the Apprentices Act, 1961 as amended from time to time from the RDATs concerned. For the benefit of all, the Railway units should keep in mind the following steps while considering candidates for training under the Apprentices Act, 1961:-

(a) The candidates should possess the requisite qualification as laid down in the Act/ Apprenticeship Rules as amended from time to time.

(b) Requisite reservation, viz. SC/ST/OBC, Disability, etc., as laid down should be followed.

(c) Selection of training be done in the trade in which the candidate has requisite qualification and not in any other trade.

(d) The contract should be signed by the Act Apprentices and the designated Railway authority on the prescribed form before the commencement of training.

(e) The above contract should be sent to the concerned RDATs for registration within a period of 3 months of the date on which it was signed.

(f) Obtain a copy of the registered contract form RDAT and place the same in the personal file of the candidate.
