Please find enclosed herewith a copy of a letter No.DGE&T-50(3)/2006-AP, dated 24.04.2006 issued by the Directorate General of Employment & Training, Ministry of Labour regarding reservation of 3% seats for persons with disabilities in the engagement of the Apprentices under the Apprentices Act, 1961.

The same may be implemented wherever Apprentices are trained under Apprentices Act, 1961.

Sub: Reservation of 3% seats for persons with disabilities in the engagement of the Apprentices.

I am directed to forward herewith a copy of DGE&T letter No.46(24)/80-AP, dated 12.03.1981 regarding reservation of 3% seats for persons with disabilities in the engagement of the Apprentices under the Apprentices Act, 1961. Further, I am directed to inform you that under the Apprentices Act, 1961, the physical standards have been relaxed in 44 trades for the category of deaf and dumb persons, 63 trades for visually impaired and 40 trades for orthopedically impaired.

You are requested to take necessary action accordingly.

Sub: Implementation of Apprentices Act, 1961 – engagement of physically handicapped persons as Apprentices.

1.     I am directed to say that various organizations connected with the Welfare of the Physically Handicapped Persons have adversely commented regarding inadequate facilities for Apprenticeship Training to that category of people in-spite of the commitment of the Government in this regard.

2.     The Prime Minister in the 20 Point Economic Programme has made a special reference to the need for a fair deal  to the minorities and weaker sections of the society in the engagement of apprentices and as you are aware, the Physically handicapped come under one of the categories of the weaker sections of the society. While considering the extension of benefits to the weaker sections of the society in their engagement as apprentices, specific administrative instructions were issued by Government of India to provide 3% of the located seats for the physically handicapped persons. In spite of this, it is observed that the quota of 3% of the located seats for apprentices to be utilized for the physically handicapped has not so far been achieved either in the private or State public sector or in the Central Sector establishments.

3.     It may be relevant to mention here that instructions have been issued by the Ministry of Home Affairs (Department of Personnel & Administrative Reforms) to all concerned for the reservation of posts in the civil service in the category of Group ‘C’  and ‘D’ for the physically handicapped persons as detailed below:-

  Category of the handicapped % of the reservation
1 Blind 1%
2 Deaf 1%

In view of the above instructions, it is all the more imperative that the physically handicapped are provided apprenticeship training so that their employment potential is enhanced to enable them to aspire for all categories of posts requiring skill.

4.     It is, therefore, requested that all-out efforts may be made to ensure that 3% of the located seats are reserved for physically handicapped persons in the engagement as apprentices. You are requested to kindly keep this Ministry informed about the action taken in the matter immediately.

GSR 107 – In exercise of the powers conferred by sub-section (1) of section 37 of the Apprentices Act, 1961 (52 of 1961) and after consulting the Central Apprenticeship Council, the Central Government  hereby makes the following rules further to amend the Apprenticeship Rules, 1991, namely:-

1. (1)   These rules may be called the Apprenticeship (Amendment) Rules, 1998.

(2)   They shall come into force on the date of their publication in the Official Gazette.

2. In the  Apprenticeship  Rules, 1991, in rule 4, in sub-rule (1) in the proviso, the following shall be inserted at the end, namely:-

“(h) Group No.1 – Machine Shop Trades Group:

  1. Fitter
  2. Turner

(i)    Group No.3 – Metal Working Trades Group:

  1. Sheet Metal Worker
  2. Welder (Gas and Electric)

(j)    Group No.4 – Electrical Trades Group:

  1. Wireman.”
