Sub: Admissibility of family pension under Liberalized Pensionary Awards in case of compassionate ground appointments – Clarification regarding.

Instances have come to Board’s notice that Liberalized family pension is being denied by some of the Railways to the dependent family members of Railway servants killed by terrorists etc. while on duty, on the basis of stipulations contained in para 5 of Board’s letter No.F(E)III/84/PN1/20, dated 16.03.1985 to the effect that appointment on compassionate ground should not be given in cases where Liberalized Pensionary Awards have been granted. Therefore, in cases where compassionate appointments are offered to the dependent family members of the deceased Railway employee even after 01.01.1986, papers are not being forwarded to Board’s office by the Railways for grant of liberalized family pension in such cases. 

Attention in this connection is invited to para 11 of consolidated instructions issued vide Board’s letter No.F(E)III/90/PN1/29, dated 16.10.1990 (RBE No. 183/1990) wherein it is stated that these orders apply to all cases arising on or after 01.01.1986. Therefore, it is clarified that the stipulation contained in para 5 of Board’s letter dated 16.03.1985 is no longer applicable to cases arising on or after 01.01.1986, as no such restriction has been laid down in Board’s letter dated 16.10.1990. The cases arising on or after 01.01.1986 may, therefore, be dealt with accordingly.
