RBE No. 240/1990: Fixation of Pay – Counting Special Pay

No.PCIII/79/SP-1/UDC, dated 26.12.1990

Sub: Grant of Special Pay of Rs.35 p.m. to the UDCs in the non-Secretariat Administration Office – Clarification as to whether this amount to be taken for purposes.    

Instructions were issued in terms of Board’s letter No.PCIII/79/SP-1/UDC, dated 02.08.1989 that the pay of those UDCs who were drawing special pay of Rs.35 p.m. in terms of Board’s letter of even number dated 11.07.1979 and were promoted to higher grade posts prior to 01.09.1985 and who fulfill the conditions mentioned vide letter number dated 27.11.1987 may be re-fixed on notional basis from the date of their promotion by taking the special pay of Rs.35 p.m. into account and the actual benefit may be allowed to them only from 01.09.1985 without payment of arrears. Consequent upon this references were received from Zonal Railway administration seeking clarification whether pensionary benefit will be allowed to those staff who retired prior to 01.09.1985 and whose pay were re-fixed notionally taking the special pay of Rs.35 p.m. into account in terms of Board’s letter referred to above.

The matter has been examined in consultation with Department of pension and Pensioners Welfare. It has now been clarified that as the order dated 02.09.1989 only provides that the actual benefit may be allowed from 01.09.1985 without payment of any arrears, the increased pay not actually drawn cannot form the basis or be allowed to be taken into account for computation of pension.
