RBE No. 241/1990: Fixation of Pay – Counting Special Pay

Sub: Grant of Special Pay of Rs.35 p.m. to the Upper Division Clerks in the Non-Secretariat Administrative offices – Question whether this amount should be taken into account in the fixation of pay on promotion – Decision regarding.       

1.     Attention is invited to this Ministry’s letter of even number dated 27.11.1987 on the subject cited above. According to the provision of the said letter special pay of Rs.35 paid to UDCs under Ministry of Railway’s letter dated 11.07.1979 shall be taken into account for fixation of pay on promotion subject to the conditions:

(a) That the incumbent is a substantive holder of the post to which the special pay is attached.

OR

(b)That the incumbent, on the date of his appointment to higher post, is officiating in the lower post to which the special pay attached continuously for a period of not less than three years.

2.     With the issue of Ministry of Railway’s letter No.E(NG)I/88/CNS/2, dated 20.10.1989 simplifying the confirmation procedure viz. there will be only one confirmation in the career of Government servants at the entry stage instead of confirmation in successive posts and grades and delinking of confirmation from the availability of permanent posts, the concept of confirmation/ substantive appointment has undergone a change. The matter has been under consideration of the Government whether the conditions stipulated in this Ministry’s letter dated 27.11.1987 ibid should continue in the changed circumstances or the same should be modified to bring them on the lines of the revised confirmation procedure. In terms of the revised confirmation procedure, a UDC who has been promoted to that grade on regular basis from a lower entry grade post in which he has already been confirmed should be deemed to have been confirmed in the post of UDC also. Accordingly, the President is now placed to decide, that, special pay of Rs.35 (raised to Rs.70 with effect from 01.01.1986) should be taken into account for fixation of pay on promotion if he is deemed to have been confirmed in the post of UDC as per guidelines mentioned in Ministry of Railway’s letter No.E(NG)I/88/CNS/2, dated 20.10.1989 ibid. Thus the condition at (a) in para 1 above will be treated as modified to this extent.

3.     These orders will come into force with effect from 01.04.1988.
