RBE No. 223/1989: Fixation of Pay – Merger of Scales

Sub: Fixation of pay in the RS(RP) Rules, 1986 – Clarification regarding merger of pre-revised pay scales of Rs.425-640 and Rs.455-700 and got replaced by a single scale of Rs.1400-2300.

1.     Consequent upon the introduction of the Revised Scales of pay, 1986, with effect from 01.01.1986, the pre-revised scale of Rs.425-640 and Rs.455-700, which were in operation as functional grade, got replaced by a single scale of Rs.1400-2300 (RPS). In the Cash and Pay Department, the scale of Rs.455-700 was promotional scale for Rs.425-640.

2.     An employee was promoted from scale Rs.425-640 to scale Rs.455-700 with effect from 20.12.1985 and then requested to have his pay fixed initially under FR 22-A and then under FR 22-C/ 2018-B from the date of his next increment in the lower scales after 01.01.1986. Fixation of pay in the revised pay scales, 1986 under Rule 2018(B) R.II (FR 22-C) with effect from his next date of increment was not allowed by the Railway on the ground that there was no lower scale available.

3.     The matter was referred to Department of Personnel and Training, who have clarified that since Note to Rule 7 of the RS(RP) Rules, 1986, is attracted in such cases, the employee is not entitled to any re-fixation of pay after 01.01.1986. However, the position being peculiar, he may be allowed a revised option to get his pay fixed under FR 22-C straight away, with effect from the date of the promotion before 01.01.1986.

4.     In another case, the employee who is senior to the aforesaid employee was also promoted along with the aforesaid employee from scale 425-640 to 455-700 with effect from 20.12.1985 but he actually took over the charge of the higher responsibility with effect from 30.01.1986, i.e. after 01.01.1986. Since after 01.01.1986, the scales of Rs.425-640 and Rs.455-700 have been given a common replacement scale of Rs.1400-2300 his promotion got nullified. The Department of Personnel and Training have clarified that in such a situation, the employee is not also entitled to any stepping up of pay.

5.     The cases in similar situations may be decided accordingly in consultation with the Financial Advisor and Chief Accounts Officer.

6.     This issues with the concurrence of the Finance Directorate of The Ministry of Railways.
