Note:

(1) The Railway Board may impose any of the penalties specified in rule 6 on all non-gazetted Railway Servants employed in the offices mentioned in this Schedule-I and place them under suspension.

(2) The penalty of compulsory retirement or removal or dismissal from service shall be imposed only by the Appointing Authority or an authority of equivalent rank or a higher authority.

    1, In one DAR case ,punishment of three stages down from 56900 to 50500 pay, for one year , order given in Jan, 2018 but for no reason that was being implemented from Dec ,2018(deduction started) and order was not acknowledged by employee .please tell me what to do and how far it is justified ? 2,and above punishment imposed and effected from dec,2018 before that,previous punishment 3 years with holding of increments from 2012 to 2015 , completed but pay and increments not restored till date and advise me for further action and appeal please.

    3,advise me in the same case, FIRST (CHARGE SHEET SF-V)DAR PENDING FROM DEC,2014 TO DEC ,2018 for finalizing the case and imposition of punishment started from DEC,2018 as above please.
    4, second CHARGE SHEET SF_V issued in 2017, March and still not finalized.and my MACP_I ,regular promotion( IN PANEL IN 2012)kept pending till date and almost 50 juniors were promoted till date and i was in loss of 25,000 rupees per month for last few years .

    5.I put many grievances in NIVARAN and SAMADHAN portal also but no responce till date besides many representations .kindly advise me.

      1. Penalty of reduction to lower stage starts immediately. It is of no matter that delinquent receives it or not. Making effect of penalty after a long time is not justified.
      2. If penalty of withholding of increments was with non-cumulative effects (without postponing future increments) then only, pay & increments are to be restored on completion of the penalty, but, if the penalty is with cumulative effects then increments are lost for ever.
      3. As regards your 4th query, no specific reply can be given by us without going through all your DAR cases.
      4. In the eyes of law, repeated representations do not prolong limitation to file case before Tribunal/ Court. In the circumstances of your case, it is suggested to please file appeal/ revision appeal within the prescribed time limit and if still not satisfied, OA may be filed in the Tribunal of the jurisdiction.
