IREM Rule No.313: Seniority of Medically Unfited Railway Servants/स्वास्थय की दृष्टि से अनुपयुक्त ठहराए गए रेल कर्मचारी की वरिष्ठता
313. (a) (i) Medically de-categorized staff may, as far as possible, be absorbed in such alternative posts which should broadly be in allied categories and where their background and experience in earlier posts could be utilized. For example, traffic running and operating, staff need not necessarily be absorbed in the ticket checking cadre alone but they could also be absorbed in other commercial, station or yard categories.
जो कर्मचारी स्वास्थ्य के आधार पर विकोटिकृत कर दिए जाएं, उन्हें जहां तक संभव हो, ऐसे वैकल्पिक पदों में आमेलित कर लिया जाए जो संबद्ध कोटियों में हो और जहां उनके पिछले पदों के अनुभव का उपयोग किया जा सके I उदाहरण के लिए, यह आवश्यक नहीं है कि यातायात चालन और परिचालन कर्मचारी केवल टिकट जांच संवर्ग में ही आमेलित किए जाएं, बल्कि उन्हें अन्य वाणिज्य, स्टेशन या यार्ड कोटियों में भी आमेलित किया जा सकता है ।
(ii) The medically de-categorized staff absorbed in alternative posts, whether in the same or other cadre, should be allowed seniority in the grade of absorption with reference to the length of service rendered in the equivalent or corresponding grade, irrespective of the rate of pay fixed in the grade of absorption under the extant rules. In the case of staff who are in grade higher than the grade of absorption at the time of medical de-categorization, total service in the equivalent and higher grade is to be taken into account.
Provided that if a medically de-categorized employee happens to be absorbed in the cadre from which he was originally promoted, he will not be placed above his erstwhile seniors in the grade of absorption.
स्वास्थ्य के आधार पर विकोटिकृत किए जाने के कारण वैकल्पिक पदों में, चाहे उसी संवर्ग में या दूसरे संवर्ग में आमेलित किए गए कर्मचारियों की वरिष्ठता, समकक्ष या तदनुरूप ग्रेड में की गई सेवा की अवधि के संदर्भ में दी जानी चाहिए, इसमें वर्तमान नियमों के अधीन आमेलन के पद में नियत की गई वेतन-दर पर विचार नहीं करना चाहिए I जो कर्मचारी स्वास्थ्य के आधार पर विकोटिकृत ठहराए जाने के समय आमेलन के ग्रेड से ऊँचे ग्रेड में हो उनकी वरिष्ठता निश्चित करने में समकक्ष और ऊंचे ग्रेड की कुल सेवा हिसाब में ली जानी चाहिए ।
परंतु यदि स्वास्थ्य के आधार पर विकोटिकृत ठहराया गया कोई कर्मचारी यदि उसी संवर्ग में आमेलित कर लिया जाए जिससे प्रारंभ में उसकी पदोन्नति हुई थी, तो उसे आमेलन के ग्रेड में तत्कालीन वरिष्ठ कर्मचारियों से ऊपर स्थान नहीं मिलेगा I
(iii) While absorbing the medically de-categorized Running Staff in alternative posts, a percentage of basic pay representing the pay element in Running Allowance, as decided by the Government through administrative instructions from time to time, should be added to the minimum as well as maximum of the scale of pay for purposes of identifying ‘equivalent’ posts and their seniority should then be fixed in the equivalent absorbing posts.
स्वास्थ्य के आधार पर विकोटिकृत ठहराए गए रनिंग कर्मचारियों को वैकल्पिक पदों में आमेलित करते समय, समय-समय पर प्रशासनिक अनुदेशों के माध्यम से सरकार द्वारा यथा विनिश्चित रनिंग भत्ते में वेतन तत्व के रूप में, मूल वेतन का एक निश्चित प्रतिशत ‘समकक्ष’ पदों की पहचान के प्रयोजनार्थ वेतन के न्यूनतम तथा अधिकतम वेतन में जोड़ दिया जाना चाहिए । तत्पश्चात उनकी वरिष्ठता समकक्ष आमेलक पदों में निश्चित की जानी चाहिए ।

(b) Railway servants whose services were terminated either because of the maximum limit of all leave including extraordinary leave having been exceeded or the medical authorities could not recommend the grant of extraordinary leave in the case of tuberculosis, pleurisy and leprosy patients and are re-employed in railway service after being declared fit to work by the medical authority should take their seniority below all permanent railway servants on the date of their re-employment provided they were permanent before medical unfitness or would have been confirmed in the meantime. Railway servants who were officiating or temporary at the time of medical unfitness or would not have been confirmed in the meantime should be placed below the officiating or temporary employees as the case may be on the date of their re-employment.
जिन रेल कर्मचारियों की सेवाएं इसलिए समाप्त कर दी गई थी कि उन्होंने असाधारण छुट्टी को मिलाकर सब प्रकार की छुट्टियां अधिकतम सीमा से भी अधिक ले ली थी या चिकित्सा प्राधिकारियों ने तपेदिक, प्लूरिसी और कोढ़ के रोगियों को असाधारण छुट्टियां देने की सिफारिश नहीं की थी और जिन्हें चिकित्सा प्राधिकारी द्वारा कार्य के लिए उपयुक्त घोषित किए जाने के बाद, रेल सेवा में पुनः नियोजित किया गया है, उन्हें उनकी पुनः नियोजन की तारीख को सभी स्थाई कर्मचारियों के नीचे वरिष्ठता मिलनी चाहिए, बशर्ते स्वास्थ्य की दृष्टि से अनुपयुक्त ठहराए जाने से पहले वह स्थाई हो या उस बीच स्थाई हो गए होते उन रेल कर्मचारियों को स्वास्थ्य की दृष्टि से अनुपयुक्त ठहराए जाने के समय स्थानापन्न या अस्थाई रूप में कार्य कर रहे थे या जो उस बीच में स्थाई हो गए होते, उन्हें उनकी पुनः नियोजन की तारीख को यथास्थिति स्थानापन्न या अस्थाई कर्मचारियों के नीचे स्थान दिया जाए ।
(c) Seniority of medically unfitted staff mentioned in sub-para (a) above, on restoration to their original posts should be determined as under:—
स्वास्थ्य की दृष्टि से अनुपयुक्त ऐसे कर्मचारियों की वरिष्ठता, जिनका उल्लेख उपर्युक्त उप-पैरा (क) में किया गया है, अपने मूल पदों पर पुनः स्थापित होने पर, निम्न रुप में निश्चित की जानी चाहिए:-
(i) Railway servants who properly appeal within the time limit laid down for appeals or whose appeal is entertained in a reasonable period waiving the time limit and get declared fit, should not lose their seniority or their claim for consideration for promotion for which they were eligible in the original category in which they were employed.
जो रेल कर्मचारी अपीलों के लिए निर्धारित समय सीमा के भीतर समुचित रुप से अपील करते हैं या जिनकी अपील पर समय सीमा में छूट देय हुए समुचित अवधि में कार्यवाही कर ली जाती है और उपयुक्त घोषित कर दिया जाता है, उन्हें अपनी नियुक्ति की मूल कोटि में अपनी वरिष्ठता या पदोन्नति के लिए जिनके वे पात्र थे, विचार करने के दावे से वंचित नहीं किया जाना चाहिए ।
(ii) Seniority of railway servants who prefer delayed appeals and are declared fit or who take treatment and consequently get declared fit, if they were formerly confirmed in the grades in which they were, would be affected to the extent of any persons who may have been confirmed before their re-absorption into the original category. If, however, they were only officiating in the original category, then their seniority should be below the staff confirmed till then, but need not be affected vis-a-vis their original juniors who happen to be till officiating.
जो रेल कर्मचारी विलंब से अपील करते हैं और उपयुक्त घोषित कर दिए जाते हैं या जो उपचार कराते हैं और उसके फलस्वरूप उपयुक्त घोषित कर दिए जाते हैं; यदि वे उन ग्रेडों में, जिन पर वे थे, पहले ही स्थाई कर लिए गए थे तो उनकी वरिष्ठता पर उस सीमा तक प्रभाव पड़ेगा जिस सीमा तक मूल कोटि में उनके पुन:आमेलन से पहले कोई अन्य व्यक्ति स्थाई कर दिया जाता। लेकिन, यदि वे मूल कोटि में केवल स्थानापन्न रूप में कार्य कर रहे थे तो उनकी वरिष्ठता उन सब कर्मचारियों से नीचे होगी जो उस समय तक स्थाई हो गए हो, इसका उनकी वरिष्ठता पर, उन मूल कनिष्ठ कर्मचारियों की तुलना में कोई प्रतिकूल प्रभाव नहीं पड़ेगा जो अभी भी स्थानापन्न रूप में कार्य कर रहे हो ।
(d) In the case of staff coming to a new unit on own request by accepting bottom seniority and then getting medically de-categorized, provision of sub-Para (a) (ii) above will be applicable only to the extent of service in the new unit.
नई यूनिट में अपने अनुरोध पर आने वाले उन कर्मचारियों के मामले में, जो निम्नतम वरिष्ठता स्वीकार कर लेते हैं और फिर स्वास्थ्य के आधार पर विकोटिकृत घोषित कर दिए जाते हैं, उपर्युक्त उप-पैरा (क) (ii) के उपबंध नई यूनिट में उनकी सेवा की सीमा तक ही लागू होंगे ।

(e) In the case of staff who are not required to undergo periodical medical examination but who of their own accord request for change of category on grounds of health, and are recommended change of occupation by the medical authority, their change will be treated as transfer on own request and dealt with as per para 312.
उन कर्मचारियों के मामले में, जिनके लिए आवधिक स्वास्थ्य परीक्षा कराना आवश्यक नहीं है परंतु वे अपनी ओर से स्वास्थ्य के आधार पर कोटि में परिवर्तन का अनुरोध करते हैं, और चिकित्सा प्राधिकारी द्वारा व्यवसाय के परिवर्तन की सिफारिश की जाती है, उनके अपरिवर्तन को अपने अनुरोध स्थानांतरण के रूप में माना जाएगा और पैरा 312 के अनुसार कार्यवाही की जाएगी ।
