Sub: Extension of deputation period of non-gazetted Railway employees with Public Sector Undertakings beyond 3 years.
1. In terms of the instructions contained in this Ministry’s letter No.E(NG)I/89/DP/24, dated 01.11.1989 (RBE No.269/1989), as reiterated in individual cases from time to time, the proposals for obtaining competent authority’s approval to the extension of deputation period of non-gazetted Railway employees with RITES/ IRCON/ CONCOR/ CRIS are required to be submitted well before the expiry of the three-year or four-year period, as the case may be. It has been specifically laid down that such proposals should be made to the Board by the borrowing organisation along with concurrence for such extension from the Zonal Railway/ Production Unit concerned, at least three months before the expiry of the sanctioned deputation period. In no case should competent authority’s approval be taken for granted or presumed and the employee should invariably be repatriated if approval for extension is not received before expiry of the approved period of deputation.
2. However, it has come to the notice of the Board that:-
(a) Proposals are not submitted in due time;
(b) Relevant columns in the prescribed proforma are left blank;
(c) The employees on deputation are shifted from one project to another;
(d) Concurrence of the parent Railway/ PU is not obtained before sending the proposal to the Board;
(e) Instructions of the Ministry to repatriate the employee concerned, wherever proposals for extension are not approved, are disregarded.
3. In a recent case, the Minister of Railways has taken a serious view of the lapses brought out above. The Ministry of Railways, therefore, wish to reiterate that their extant instructions on the subject must be scrupulously observed without any default. A mechanism should also be devised to ensure that unauthorised extension of deputation terms do not occur in future.
