1. The amended Certificate of Registration No.S-33475, dated 03.06.2015 (Provisional) along with the Amended Constitution of All India Other Backward Classes Railway Employees Federation registered (Provisional) on 03.06.2015 under Societies Registration Act XXI of 1860 by the Registrar of Societies/ Government of NCT of Delhi has been made available to Board’s office by the General Secretary of the said Federation.
2. A copy of the same is circulated (Provisionally) herewith for information and guidance in regulating the functioning of AIOBCREF and AIOBCREA. The few clauses/ instructions as laid down in Board’s letters under reference stands amended (provisionally) to the extents as contained in the above mentioned amended Constitution of All India Other Backward Classes Railway Employee Federation (Registration No.S-33475), dated 03.06.2015 (provisional) till further orders, subject to outcome of court case(s), if any.

1. The name of the society is All India Other Backward Classes Railway Employees Federation, Indian Railways.
2. The Registered Office of the Society is at present situated at present Room No.48, Railway Board, Rail Bhavan New Delhi-110001.
3. Head Quarters:
The headquarters of the federation shall be at Delhi.
4. The aims and objectives of the Federation for which the society is formed are:-

(a) It is only the welfare federation of genuine Other Backward Classes Railway Employees Association and membership is open to all Other Backward Classes Railway Employees Association functioning at Zonal Railways/ Production Units including RDSO whose office bearers list is circulated by the administration.
(b) To promote and maintain the organization of Other Backward Classes Railway Employees on all Indian Railways and independent Railway undertakings, other establishments and projects under the Railway Board.
(c) To unite and promote the economic, social and political interests of all Other Backward Classes Railway Employees.
(d) To watch, defend and promote the interest, rights and privileges of all Other Backward Classes Railway Employees, irrespective of caste, religion, creed race or sex in all matters relating to their employment.
(e) To co-ordinate the activities of all affiliated Associations and to assist them in their activities and representations.
(f) To work for the transformation of the Railways into a real national concerned run in the best interest of the common people, the country and Other Backward Classes Employees themselves.
(g) To secure and maintain for the workers:-

(I) Freedom of speech;
(II) Freedom of press;
(III) Freedom of Association;
(IV) Freedom of Assembly;
(V) Right to hold dharna and agitations;
(VI) Right to work or maintenance;

(h) To urge the Government of India to provide needful Constitutional Amendment to grant 27% Quota in promotions for the Other Backward Classes Railway employees.
(i) To work in co-operation with other class organizations of employees for the general betterment of Other Backward Classes Railway employees as a class.
(j) To work and co-operation with others, for achieving social justice.
(k) To Provide Educational aid to the children of the poor and downtrodden Other Backward Classes Railway Employees in Indian Railways.
(l) To protect the Other Backward Classes Railway Employees from harassment, victimization and discrimination from the Railway Officials and others.
(m) This Federation has no link with any recognized bodies or Federations like AIRF and NFIR.
All the income, earnings, movable, immovable properties of the Federation shall be solely utilized and applied towards the promotion of its aims and objects only as set forth in the memorandum of association and no profit on thereof shall be paid or transferred directly or indirectly by way of dividends, bonus, profits or any manner whatsoever to the present or past Members of the Federation shall have any personal claim or any movable or immovable past Members of the Federation or make any profits, whatsoever by virtue of partnership.

7. Affiliation and Membership:
Any bonafide Association of Other Backward Classes Railway Employees engaged of employment in Indian Railways, or in an Independent Railway Undertaking or in any other establishment office or project under the Ministry of Railways recognized/ circulated by Zonal/ PUs administration is eligible for affiliation only after depositing an affiliation fee of Rs.25000 (Rupees Twenty Five Thousand) for each Zonal OBC Association and Rs.12500 (Rupees Twelve Thousand Five Hundred only) for each Production Unit OBC Railway Employees Association per year in the Federation Bank Account by the President/ General Secretary of the concerned Zonal/ PU subject to the approval of General Secretary of CEC of the Federation.

(a) OBC Railway Employees Association of concerned Zonal/ Production Unit seeking Affiliation with the Federation shall apply in the prescribed form (E).
(b) Affiliation of OBC Railway Employees Association of concerned Zonal/ Production Unit with the All India OBC Railway Employees Federation, Indian Railways in an essential and compulsory requirement for functioning in the different Zonal Railways and Production Units.
(c) Without affiliation with the All India OBC Railway Employees Federation, Indian Railways OBC Railway Employees Association of any Zonal Railway/ Production Unit is not entitled for any facilities provided by the Railway Administration from time to time.
(d) Any of the office bearers of the Federation shall not involve or conduct any private and illegal business or such activity in the name of the Federation/ Association/ Association by using the designation of the Federation/ Association. In case anybody found in violating the above are liable to be debarred from the primary membership of the Federation/ Association indirectly without notice to safeguard the integrity of the Federation.
(e) Except President and General Secretary of the Federation any Executive Committee Member or office bearer or member of the Federation/ Association who is expelled, debarred, suspended, blacklisted, on any ground by the Federation is not eligible for becoming a member/ office bearer in the Association/ Federation at any level. If any person become a member and or produces the temporary membership receipt by hiding the above facts, his membership will be considered automatically cancelled and he will lose all the benefits of the membership.

8. Disaffiliation (Loss of Member):-

(a) Any affiliated Association shall lose its membership of the Federation if it fails to deposit affiliation fee in the Federation Bank Account on or before 31st March of the Year.
(b) The affiliation once given may be cancelled/ suspended at anytime if it is found that affiliated Association is working against the Aims and Objectives of the Federation or not following the directives and guidelines of the CEC issued from time to time or is in default of renewal fee or any other dues.
(c) In case of any doubt regarding cast of any office bearer or member, cast certificate can be demanded by the Present/ Working President/ General Secretary of the Zonal or CEC, failure to produce the same will lead to cancellation of membership and he/she will cease to be Member of the Federation/ Association any further and he/ she will lose all the benefit of the Association/ Federation.

9. Composition of the All India OBC Railway Employees Federation:-

(a) The General Body:-

The General body of the Federation consists of office bearers from all the affiliated Associations, whose Zonal/ Production Units OBC Association office bearers list is circulated only by the Railway Administration.

(b) The Annual General Body Meeting shall be held every year on the date and at the venue as decided by the General Secretary of the Federation (Regd. No.S-33475) for:-

(i) consideration of the report of the General Secretary;
(ii) Passing the audited statement of accounts and other reports;
(iii) Consideration of subjects, as may be referred to it by the Central Executive Committee or affiliated Association;
(iv) Electing the Office Bearers of the Federation;
(v) Notice of schedule of program of Annual General Body Meeting shall be given by General Secretary; such notice shall contain the business to be transacted at the meeting.
(vi) At least 21 days notice shall be given before convening the Annual General Body Meeting;
(vii) Resolution from the affiliated Association for consideration of the General Body should be sent to the General Secretary at least 10 days before the meeting of the General Body.

(B) The Central Executive Committee:-
Central Executive Committee (CEC) is the Governing Body of the Federation and it is the Apex Body of the Federation and its decision on all matters are binding on all the Members of the Federation and its affiliated Associations:-

The CEC consists of the following Members:-
(1) President – 1
(2) Working President – 2
(3) Sr. Vice President – 2
(4) Vice-President – 2
(5) General Secretary – 1
(6) Joint General Secretary – 15
(7) Asst. General Secretaries – 18
(8) Finance Secretary/ Treasurer – 1
(9) Auditors – 3

The tenure of CEC will be five years from the date of the General Body or from the date of circulation of the list of office bearers by the Railway Board whichever is later. In case any dispute arises the latest & existing body which has was circulated by the Railway Board and a legally valid body will continue till the dispute is settled.

(i) Retired Railway OBC employees are eligible for the election of office bearers/ Central Executive Committee members of the Federation and to become the member of the CEC, such retired Railway OBC employee should be an office bearer of the OBC Association affiliated to the Federation at the time of his/ her retirement.
(ii) The CEC is empowered to make rules regulations on the subjects for smooth functioning of the organization. The decision taken by CEC will be applicable & binding on all the associations and office bearers of OBC Associations of all Zonal Railways/ Production Units.
(iii) The Meeting of Central Executive Committee (CEC) will be held quarterly or as and when called convened by the General Secretary for which a two week notice will be given to all the members to discuss the urgent matters.
(iv) CEC/ Federation office Bearers list submitted to concerned authority for recognition and circulation must be signed by the executive General Secretary of the Federation, if the General Secretary of the Federation is newly elected, then the Federation office Bearers list submitted to the concerned authority for recognition and circulation must be signed by the outgoing General Secretary of the Federation and the incumbent General Secretary of the Federation. Otherwise the competent authority should not give any recognition to that document. In case any dispute arises the existing body which was circulated by the Railway Board and a legally valid body will continue till the dispute is settled.
(v) All the elected office bearers of the affiliated Zonal Executive Committee of OBC Railway Employees Association whose office bearers list is circulated by the administration can only be a member of the Federation and will have voting power and can participate in the election of CEC/ Office Bearers of the Federation (Regd. No.S-33475). In case of Production Units only three office bearers viz. President, General Secretary and Finance secretary will have the voting power and participate in the election of Central Executive Committee office bearers of the Federation. Divisional, Branch, Workshop and Extra Divisional office bearers will not have voting power and they cannot participate in the election of Central Executive Committee office bearers of the Federation.

10. Election Procedure:-

(a) Election for the Federation shall be held through secret ballot for electing the office bearers of the Federation. Due democratic procedure in holding the election should be adopted ensuring free, impartial participation of all members of the Federation in election of office bearers.
(b) All the elected office bearers of the Zonal Executive Committee and Retired Railway Employees whose office bearers list is circulated by the Railway Administration can be a member of the Federation and will have voting power and participate in the election of Central Executive Committee/ Office Bearers of the Federation. In case of Production Units only three office bearers viz. President, General Secretary and Finance Secretary will have voting power and participate in the election of Central Executive Committee/ Office Bearers of the Federation. Divisional, Branch, Workshop and Extra Divisional office bearers will not have voting power and they cannot participate in the election of Central Executive Committee office bearers of the Federation.
The Election will be held at least one month in advance of the expiry of the tenure so that elected office bearers took over on the date of expiry of the tenure.
Tenure of the Federation or Central Executive Committee:-
The Tenure of office bearers of the Centre Executive Committee of the Federation shall be five years or till the next circulation of the elected office bearers list by the Railway Administration/ Railway Board.

Note: In addition to the above the following condition should be fulfilled by the OBC Railway Employees Association of Zonal Bodies/ Production Units to become eligible for participation in the elections for Central Executive Committee.
The Zonal Body/ Production Units should clear all the dues including Annual Affiliation/ renewal of Affiliation as per the Constitution of this Federation.

11. Powers, Duties and Functions of the Central Executive Committee:-

(a) President: He will preside the meeting of the Federation and work with the General Secretary for the cause of the Federation. He will work for the unity of the Other Backward Classes Railway Employees for achieving social justice and aims of the Federation.
(b) Working President: In absence of the President, the Working President will perform the duties of the President.
(c) Sr. Vice President: In addition to duties assigned by the General Secretary. Sr. Vice President shall perform the duties of the President/ Working President in their absence.
(d) Vice President: The Vice President shall preside the meeting in absence of the Present, Working President, Senior Vice-President.
(e) General Secretary: The General Secretary shall carry out the following duties:-

(i) To take necessary steps for the smooth functioning of the Federation in its day to day activities such as holding of the meeting etc.
(ii) To take notices of the proceedings of the meeting of the committee and the General Body and to enter them in minutes book and get them confirmed in the next meeting of Central Executive, General Body as the case may be.
(iii) The General Secretary of the Federation have vested power to remove any office bearer of the Federation or expel any Zonal Association for involving in anti association activities.
(iv) He shall take all positive decisions in the interest of the Federation.
(v) To conduct are correspondence of the Federation the General Secretary shall sign all letters emanating from the Federation and other CEC members should not communicate any letter/ correspondence to anywhere including Railway Board.
(vi) To keep and maintain the records of the Association in proper manner.
(vii) To exercise general supervision and control over the office bearers and affairs of the Federation.
(viii) To keep in touch with all the office bearers as frequently as possible to secure the fullest co-operation of the executive member.
(ix) To maintain and up to date list of all members of Zonal Associations.
(x) To keep up to date rules of the Federation as amended by the Federation from time to time.
(xi) To prepare an annual report of the activities of the Federation and present the same at the Annual General Body Meeting.
(xii) Any other miscellaneous duties as may be assigned to him.

(f) Joint General Secretary:

(i) To assist the General Secretary in maintaining an up-to-date list of all members of the Federation.
(ii) To carry out work regarding organization matters with prior approval of General Secretary.

(g) Assistant General Secretary:

(i) Assistant General Secretary shall assist General Secretary in matters pertaining towards the zone represents.

(h) Finance Secretary/ Treasurer:

(i) To receive subscription and other donations to the Federation and deposit them in a nationalized bank approved by the Central Executive Committee.
(iii) To issue proper receipts for all money received by him on behalf of the Federation.
(iv) He shall maintain all the accounts, vouchers and receipts of various forms of income and expenditure of the Federation.
(v) To maintain the complete and up to date list of the members of the affiliated Zonal Associations and the amount due from each of them.
(vi) To maintain account of the Federation and present them to the CEC for scrutiny and as and when required.
(vii) To issue notice to Zonal Associations, who fails to pay the subscription to the Federation, with the knowledge of the Central Executive Committee.

(i) Auditor:

The Auditor(s) may be outsider(s) Railway serving employees or Retired Railway employees and also he/ she will check the accounts of the Federation and submit a report thereon to the Central Executive Committee.

12. Notice of the Annual General Body Meeting and Periods of the Meeting:

The Annual General Body Meeting shall be held every year on the date and venue as decided by the General Secretary of the Federation (Regd. No.S-33475).
Notice shall be given 21 days in advance mentioning the business to be transacted in the meeting.

13. Extra General Body Meeting or special General Body Meeting:

A meeting other than Annual General Body Meeting like Special General Body Meeting or Extra General Body Meeting may be convened whenever Central Executive Committee of the Federation deems it necessary and must be so convened on receipt of requisition by 10% of CEC members of the Federation.

14. Voting:

(a) All decisions of the Central Executive Committee, the Annual General Body Meeting or the Extra General Body Meeting of the CEC shall be made by a simple majority vote, except when a different method is specially prescribed.
(b) All voting shall be through secret ballot or by a show of hands or other methods.

15. Quorum for the meeting:

(a) The quorum for a meeting of the Central Executive Committee shall be 51% percent of the number constituting the committee.
(b) The quorum of General Body Meeting shall be the thirty percent of the total number of delegates elected to represent Zonal/ Production Units/ RDSO/ for such a meeting.

16. Percentage of OBC Railway Employees among Representatives:

All members of the constituent organization of the Federation shall be OBC Railway Employee and retired OBC Railway Employees.

17. Victimization:

Other Backward Classes Railway Employees Victimized for Association activities, the Federation will support and protect such OBC employee.

18. Funds:

Subject to the provisions of the Societies Act and of the sanction of the Central Executive Committee, its funds shall be spent on the following:-
(a) The payment of salaries, allowances and expenses of the officers of the Federation.
(b) The payment of expenses for the administration of the Federation, including the fee for the audit of accounts of the Federation.
(c) The prosecution or defence of any legal proceedings to which the Federation of officers or its affiliated Association is a party. Where such prosecution or defence is undertaken for the purpose of securing or protecting any right of the Federation or its affiliated Associations.
(d) The conduct of disputes on behalf of the Federation or its affiliated Associations.
(e) The upkeep of a periodical published mainly for the purposes of discussing questions of affecting OBC Railway employees as such.
(f) Any other expense provided in the Societies Act.

19. Custody of Funds:

(a) The Central Executive Committee shall be responsible for the safe custody of the funds of the Federation, and shall decide from time to time the bank or banks where in the funds of the Federation shall be deposited.
(b) The money deposited in the bank in the name of the Federation, shall be withdrawn only by cheque jointly signed by any two of the three (i.e.) President, General Secretary and Treasurer/ Finance Secretary.
(c) The President, Working President, General Secretary & Finance Secretary of Federation shall be allowed a recoupable imprest not exceeding Rs.10000 (Rupees Ten Thousand). A separate register shall be maintained for this purpose. The Finance Secretary/ Treasurer shall maintain the accounts of the each unit(s).
(d) The Financial Secretary/ Treasurer shall maintain the accounts of the Federation.
(e) The General Secretary shall maintain a list of the membership of the Federation for each financial year from 1st April to 31st March.
(f) The accounts and list of the membership shall be open for inspection during the office hours of the fertilization. A notice is not less than seven days shall be given in writing by any member or officer of the Federation or by any person deputed for this purpose by the Railway Administration.

20. Disciplinary Action:

Except General Secretary any office bearer or member of the Federation or any OBC Association may be suspended from the membership of the Federation or expelled by the General Secretary of the Federation for disloyal conduct or for injuring the interests of the Federation in the following manner:-
(a) The disciplinary action should be ratified by the 51% members present in the CEC meeting of the Federation within 30 days the date of its suspension or expulsion.
(b) Aggrieved party can appeal to the CEC of the Federation. The Central Executive Committee may also by a resolution impose fines and penalties for default in the fulfillment of any obligation to the Federation/ Association.

(i) In case of expulsion, and appeal shall be made to the Central Executive Committee.
(ii) The Central Executive Committee may also by a resolution impose fines and penalties for default in the fulfillment of any obligation to the Federation/ Association.

21. Vacancies:

In case of vacancies arising during the tenure of the Executive Committee at any level due to any reasons, the vacancies of office bearers of the Central Executive Committee shall be filled by nomination by the General Secretary of Central Executive Committee of the Federation. Similarly, in case of vacancies of office bearers of Zonal Executive Committee, Divisional Executive Committee and Branch Executive Committee shall be filled by the nomination by General Secretary of the concerned Zonal/ PU OBC Association with the consent of the concerned ZEC/ DEC/ BRC as the case may be.

22. Trade Union Activities:

According to the circumstances and keeping in view of larger interest of OBCs, the CEC of the Federation will take appropriate decision as per the extant rules in this regard.

23. Political Resolution:

Resolution on political questions to be adopted shall require a two third majority of the members present.

24. Constitutional Amendments:

Amendments to the Constitution can be made only by the General Body Meeting by a 51% majority of its members, present and voting. Amendments will be sent to the Registrar as per Society Act and shall not come into force till its registration with the registrar.
Any proposed amendment to the Constitution of the Federation must be notified to the delegates along with the notice the convening the meeting of the General Body Meeting.

25. Special powers of Central Executive Committee:

The Central Executive Committee may frame bye-laws and regulations not inconsistent with Constitution for the purpose of carrying out business of the Federation. Central Executive Committee has the powers to increase or re-designate the Office Bearers of the Federation. The CEC of the Federation shall be Supereme Body in all matters relating to the organization and all the decisions/ directives issued from time to time shall be binding on all Zones/ Divisions and Branches.

26. Legal Proceedings:

The Federation may sue of the sued in the name of the President/ General Secretary as per provisions laid down under Section 6 of the Societies Registration Act, 1860 as applicable to the Delhi.
All the legal disputes which may arise in connection with the Federation will be contested in the territorial jurisdiction of the courts of Delhi including the territorial jurisdiction of Delhi High Court.

27. Dissolution:

The dissolution of the Federation can only be decided upon by a special General Meeting called for this purpose after giving one month’s notice and by a majority of three-fourth of the delegates present, and after making necessary arrangements for the distribution of assets.
