RBE No. 177/2019: Public Prosecutors – Promotion to Group ‘B’ Posts – Level 8 in Pay Matrix

Sub: Selection for promotion to Group ‘B’ post of Sr. Public Prosecutor in Level 8 in Pay Matrix.

1. In compliance with the judgment dated 03.07.1997 passed by the Hon’ble High Court of Rajasthan in CWP No.465/1995 filed by Shri Sohan Singh & Anr. Vs UOI & Anr. upheld by the Hon’ble Supreme Court vide its judgment dated 29.09.2011, prosecution Cadre has been formed on the Railways by separating it from the Railway Protection Force in terms of instructions contained in Board’s aforementioned letter. Accordingly, among other posts, 68 Group ‘B’ posts of Senior Public Prosecutors in Level 8 in Pay Matrix have been sanctioned in terms of these instructions.
2. In this context, it has been decided by the Board that at the time of initial constitution of Group ‘B’ posts of Senior Public Prosecutors in Level 8 of Pay Matrix, these posts may be filled up on the basis of seniority cum suitability involving assessment of record of service of senior most Public Prosecutors in Level 7 of Pay Matrix who have completed a minimum of 2 years of non-fortuitous service in the grade. Thereafter, the posts of Sr. Public Prosecutors getting vacated may be filled up through the usual Selection procedure (including Objective type written examination, viva-voce and assessment of APARs) from amongst Public Prosecutors with 2 years of non-fortuitous service in Level 7 of Pay Matrix.
3. As has been mentioned in Board’s aforementioned letter dated 12.06.02019, the seniority list of Group ‘C’ posts of Public Prosecutors will be maintained at Board’s level in the Prosecution Department to be set up in Board’s office. The selections for promotion to Group ‘B’ post of Senior Public Prosecutors will, however, be conducted by the concerned Zonal Railways and thereafter the Panels and posting orders will also be issued by them.
