Sub:     Rules of seniority for non-gazetted staff in DCW.

1.     Reference Shri Ram Kumar, Addl. CME’s D.O. letter No.DCW(P)/Seniority/Minst/Genl/141, dated 28.04.1986 on the above subject.

2.     The Department of Railways (Railway Board) have considered the matter carefully. In keeping with the extant instructions in regard to determination of seniority of non-gazetted staff and the rules framed earlier by the Wheel and Axle Plant, Bangalore, the Department of Railways have decided that the rules adopted by Wheel and Axle Plant, as approved/ modified by the Board May be followed mutatis-mutandis by DCW, Patiala. A copy of these rules is enclosed as Annexure to this letter.

3.     The Board have further decided that these rules should be followed by RCF, Kapurthala also.

Sub:     Principles for determining seniority of staff working in the Wheel & Axle Project, Bangalore.

The following principles are laid down for determining the seniority of non-gazetted staff working in this Project as well as those who may be drafted to this Project from time to time in the future:-

1.     All posts in this Project, for the present are temporary and are normally filled by drafting staff from different Railways and Production Units and in a few cases by resorting to direct recruitment.

2.     Till the declared date of commencement to production, all postings and promotions ordered in the Project are deemed fortuitous and purely provisional without any prescriptive right for the staff for any such posting/ promotion and/or continuance in the same grade/ post.

3.     Staff directly recruited for the Project are deemed to be suitable for absorption in the Plant in their recruitment grades and their seniority shall be based on the merit order assigned at the time of their recruitment. Candidates who are sent for initial training will rank in seniority in the relevant recruitment grade in the order of merit obtained at the examination held at the end of the training before being posted against working posts.

4.     Staff transferred from different Railways/ Production Units upto the declared date of commencement of production will be deemed to have been transferred to the plant on that date, and the grade held by them on the parent railways or the grade they would have held on that date but for transfer to the Project, and the length of continuous non-fortuitous service therein will determine the relative seniority, subject to inter-se seniority in the parent railway being maintained.

5.     An employee who has already been promoted against a vacancy will not be disturbed merely to provide for another employee who happens to be senior to him but who joins the project later. The senior staff will have to wait for his promotion till the next vacancy arises in the higher grade. Once promoted to the higher grade, his seniority position will be restored. No reversion or promotion will be ordered with retrospective effect.

6.     A duly Constituted screening Committee will be set up soon after the declared date of commencement of production to screen all the Staff other than those directly recruited and to decide on their permanent absorption or otherwise, based on the cadre position in each department. Staff not recommended by the Screening Committee for permanent absorption in this Project, and those not willing for absorption will be returned to their parent Railway/ Production Units.

7.     As for Ministerial staff, broadly the following will be the groups for determining the seniority in the Project stage i.e. before the declared date of commencement of production:

(1) Personnel.

(2) Accounts.

(3) Stores.

(4) Mechanical, Electrical, General & Security.

(5) Civil.

8.     For non-ministerial staff, their seniority will be category-wise (viz. only one seniority for each trade).

9.     Soon after the declared date of commencement of production, their seniority lists drawn on the basis of the above principles will be circulated amongst all staff. Individual representations, from the staff in regard to the data furnished in the seniority list will be considered on merits, if submitted within two months from the date of publication of the seniority list, after which no such representation will be considered and the seniority list thus circulated will be treated as final. The screening Committee with the approval of the competent authority will also decide the promotion group for ministerial staff in the final set up.

10.   No appeal will be entertained against the above principles laid down for determining the seniority of non-gazetted staff and will be binding on every non-gazetted staff of this Project. All the non-gazetted staff, who are inducted to this Project (including all the existing staff) should furnish a declaration as under:
