Sub: Implementation of restructuring orders for various categories of staff – benefit to retired staff.
1. As the Railway Administrations are aware, restructuring of a number of cadres including RPF/RPSF has been done in the recent past. In the restructuring orders, it has been provided that the staff who would be placed in the revised grades in terms of these orders would be eligible to draw pay in higher grade from a common date and in a few orders from at retrospective date either on proforma or cash basis.
2. A question has been raised whether the benefit of these restructuring orders should be extended to Railway servants who were in service on the date of effect of restructuring orders but retired from service or died before the restructuring orders could be implemented. The question has been under consideration of the Ministry of Transport (Deptt. of Railways) for quite some time. It has now been decided that the benefit under the restructuring orders may be allowed to such of the Railway servants who were in service as on the crucial date for restructuring.
3. The benefit in terms of restructuring orders will be in respect of promotion to the immediate higher grade i.e. the benefit will be extended only for the first promotion and not for any subsequent promotion, even if a person was due, therefore, in terms of the relevant restructuring orders. This is subject to the condition that the employee is otherwise eligible and suitable for and due promotion to the immediate higher grade as per the provisions in the restructuring orders.
4. Since a person who is eligible to get the benefit in terms of these instructions, would have quit service before the implementation of the restructuring orders, the benefit will be only in the form of notional or proforma fixation of pay.
5. The pay thus fixed notionally or proforma will be counted for the purpose of calculation of retirement benefits
6. In cases where the vacancies in the higher grades have been filled by staff in service; the retired staff who would have been allowed pay of the higher grade on notional or proforma basis in terms of these instructions, may be allowed the benefit of proforma fixation in higher grade and the same counted for the purpose of calculation of retirement benefits as indicated in para 5 above and promotions already ordered to higher grade posts allowed to stand.
7. In cases where retired Railway servants have already been allowed in a Railway Administration the benefit of the aforesaid restructuring orders otherwise than as provided for above, the same may be allowed to stand i.e. such cases may not be re-opened.
8. These orders are applicable only to restructuring sanctioned by this Ministry under letter No.PCIII/80/UPG/19, dated 24.07.1983 and under subsequent letters.
9. Paras 2 to 7 above have the sanction of the President.
