RBE No. 86/1999: Persons with Disabilities – IREM Amendment – ACS No.75 & 76
No.E(NG)I/90/PM1/2, dated 29.04.1999
Sub: The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 – Non-discrimination in the matter of promotion of staff acquiring disability during service – Amendment to IREM.
1. As the Railway Administrations are aware, the physically handicapped persons recruited on the Railways are considered for promotion in their turn based on their eligibility and suitability and there is no discrimination against them in this regard merely on the ground of physical disability. However, the enactment of ‘The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995’ has necessitated incorporating there non-discriminatory provisions in the Manual. These provisions apply equally to the staff who acquired disability during service and are observed in suitable alternative employment as per provisions of Chapter-XIII of Indian Railways Establishment Manual, Volume-I (Revised Edition 1989).
2. The Ministry of Railways after considering the matter have decided that the Indian Railways Establishment Manual, Volume-I (Revised Edition 1989) may be amended as in the Advance Correction Slip No.75 and 76 enclosed.
