RBE No. 64/1995: Inter-divisional Transfer – Ticket Checking Staff – Seniority

Sub: Transfer/ Re-transfer of Ticket Checking Staff – Determination of Seniority.

1. Attention is invited to Board’s letter of Even Numbers dated 05.05.1994 (RBE No. 37/1994) wherein it has been clarified that seniority of ticket checking staff, transferred from one Division to another for various reasons like suspected malpractices, who are fully exonerated or awarded a penalty of censure after finalization of disciplinary proceedings, on their transfer back to their parent Division, may be fixed on the basis of the circumstances in which the transfer-back-to-the-parent-Division comes about.

2. This issue came up for discussion in the PNM meeting with AIRF on 15/16.03.1995 when the staff side desired that the transfer back of such employees should only be on administrative ground causing no loss of seniority.

3. The matter has since been considered and it has been decided that a Ticket Checking Staff who is transferred from one seniority unit to another seniority unit (inter-divisional/ inter-zonal transfers) on grounds of suspected malpractices and in whose case the disciplinary proceedings fail to prove any charge thereby exonerating the employee fully, may be transferred back to the original seniority unit on review of his case on his request, without any loss of seniority. No transfer allowance will however be admissible in such cases.
