RBE No. 57/1997: Promotion – Effect of Adverse Comments in Confidential Reports

Sub: Adverse comments in Confidential Reports which have not been communicated – Effect thereof on consideration for promotion – Item No. 63/96 in the JCM-DC.

1. Instructions contained in Board’s letter No.E(NG)I/78/CR/2, dated 10.11.1978 require adverse remarks in the Confidential Reports to be communicated to the Railway Servant concerned within one month of their being recorded, allowing representation against such adverse remarks within one month of their communication and expeditious disposal of such representations and in any case within three months from the date of submission of the representation. Adverse remarks are not deemed as operative if any representation filed within the prescribed time limit is pending. The manner in which the Departmental Promotion Committee should proceed in cases where the adverse remarks in the Confidential Reports have not been communicated, has been laid down in the Board’s letter No.E(NG)I/91/CR/2, dated 10.06.1993 (RBE No. 92/1993).
2. In the meeting of the Departmental Council under the Joint Consultative Machinery held on 9th/ 10th January, 1997, the Staff Side pointed out that the above instructions are not being adhered to and the affected staff are denied promotions. After discussion it was agreed to reiterate the extant instructions in the matter. Accordingly, the extant instructions as contained in Board’s letter No.E(NG)I/91/CR/2, dated 10.06.1993 (RBE No. 92/1993) (copy in closed for ready reference) are hereby reiterated for strict compliance.
