RBE No. 25/1993: NFSG (Non-Functional Selection Grade) – Sealed Cover Procedure – Group ‘A’ Service

Sub: Sealed cover procedure – Selection Grade in Group ‘A’ Services – Non-functional Selection Grade appointments.

1. According to Para 3 of Department of Personnel’s OM No.22011/2/86-Estt.(A), dated 12.01.1988 [circulated vide Board’s letter of even number dated 21.09.1988 (RBE No. 210/1988)] regarding the procedure for promotion of Gazetted Officers against whom disciplinary/ court proceedings are pending, the officer, in case he is completely exonerated, may be promoted notionally with reference to the date of promotion of his junior but he will not be allowed any arrears of pay for the period preceding the date of actual promotion. The Department of Personnel has since issued the following instructions vide their O.M. No.22038/1/88-Estt.(D), dated 22.11.1990 in the matter of sealed cover procedure for promotion of officers to Non-Functional Selection Grade of Group ‘A’ services:-

In the recommendations in respect of a person for appointment to NFSG are kept in sealed cover, the NFSG vacancy should be kept unfilled till the disciplinary proceedings are completed. In such cases, it is not permissible for a junior person to officiate in the vacancy. In the meantime, the post will only be operated at JAG level. If, on finalization of the disciplinary proceedings, the officer is fully exonerated, he will be entitled for appointment to the NFSG from the date from which it was due and also for arrears of pay on that account.”

2. The above instructions take effect from 20.11.1990.
3. This issues with the concurrence of Finance Directorate of this Ministry.
