Sub: Promotion from Group ‘B’ to Group ‘A’ and within Group ‘A’ of Railway Officers – Circumstances in which case is to be kept in sealed cover – regarding.

Board have reviewed the provisions relating to procedure/ guidelines to be followed in case of promotion of Railway Servants issued vide Board’s letter No.E(D&A)92 RG6-149(B), dated 21.01.1993 (RBE No. 14/1993) in the light of judgment of Supreme Court in the case of Sh. H.C. Khurana (AIR 1993 Supreme Court 1488) and Sh. Kewal Kumar (Civil Appeal No. 1584 of 1993) and CAT/Mumbai judgment dated 24.12.1999 in the case of Sh. R.K. Mittal (O.A. No. 909/1999) and have decided that the stage for invoking sealed cover procedure should be treated as the one where on conclusion of the investigation, conscious decision has been taken by the Disciplinary Authority for initiating disciplinary proceedings.
