Sub: Implementation of Government’s decision on the recommendation of the Sixth Central Pay Commission.

1.     A copy of Department of Pension & Pensioners’ Welfare (DOP&PW)’s OM No.38/37/08-P&PW(A), dated 11th December, 2008 on the above subject, is attached for information and compliance. These instructions shall apply mutatis mutandis on the Railways also. DOP&PW’s OMs dated 02.09.2008 and 03.10.2008, referred in the enclosed OM were adopted on the Railways vide this office letters of even number dated 15.09.2008 (RBE No. 112/2008) and 10.10.2008 (RBE No. 149/2008) respectively.

OFFICE MEMORANDUM

Sub:     Implementation of Government’s decision on the recommendation of the Sixth Central Pay Commission.

1.     The undersigned is directed to say that in pursuance of Government’s decision on the recommendations of Sixth Central Pay Commission, orders were issued vide this Department’s OM No.38/37/08-P&PW(A), dated 02.09.2008 for introducing modifications in the rules regulating pension, etc. Clarifications on certain provisions in this O.M. were also issued vide OM No.38/37/08-P&PW(A), pt.II, dated 03.10.2008. In accordance with the instructions contained in this OM, only the Government servants who retire on or after 02.09.2008 are eligible for calculation of pension at 50% of the emoluments (ie. last pay drawn) or average emoluments whichever is more beneficial to the Government servant.

2.     A number of references are being received in this Department in this respect. The matter has been reviewed in consultation with the Ministry of Finance (Department of Expenditure). It has now been decided that the provision for payment of pension at 50% of the emoluments (pay last drawn) or 50% of average emoluments received during the last 10 months, whichever is more beneficial to the retiring employee, shall be applicable to all Government servants retiring on or after 01.01.2006. However, only those Government servants, who retired during 01.01.2006 to 01.09.2006 after completion of 33 years of qualifying service, will be eligible for full pension and the pension of those Government servants, who retired during 01.01.2006 to 01.09.2008 with qualifying service of less than 33 years, will continue to be proportionate to the full pension based on their actual qualifying service.

3.     This issues with the concurrence of Ministry of Finance (Department of Expenditure) vide their I.C. U.O.No.4.2/22/2008-IC, dated 08.12.2008.
