RBE No. 18/2005: Promotion – Group ‘B’ officers – Disciplinary/ Court Proceedings Pending

Sub: Placement of Group ‘B’ Officers against whom disciplinary/ court proceedings, etc., are pending, in the higher pay scale of Rs.8000-13500 – Procedure and guidelines to be followed.

1. Attention is invited to Board’s letter No.E(D&A)2003/2/22, dated 16.06.2003 (RBE No. 93/2003) outlining the procedure to be followed for placement of 80% Group ‘B’ Officers in scale of Rs.7500-12000, in the higher Group ‘B’ scale of Rs.8000-13500.

2. Board have decided that the sealed cover procedure as laid down in their letter No.E(D&A)92 RG6-149(B), dated 21.01.1993 (RBE No. 14/1993) would be applicable also in respect of placement to Group ‘B’ Officers in the higher scale of Rs.8000-13500. Since the date of effect of placement in the higher scale is 1st January and 1st July every year, sealed cover procedure would apply only if the officer is under suspension or disciplinary/ Court proceedings are pending against him as on 1st January/ 1st July and not as on the date his case for placement in higher scale is actually considered by the Committee of HODs. In case of initial placement in the year, 2003, applicable of sealed cover procedure in a case would depend upon the position as on 25.04.2003, i.e., the date from which the placement in the higher pay scale was initially made effective.

3. Board have also decided that the eligibility of a Group ‘B’ officer, finding in respect of whom are kept in sealed cover by the Committee, for placement in the higher scale of Rs.8000-13500 on conclusion of disciplinary proceedings, etc., shall be decided in accordance with the procedure contained in para 3.2 of Board’s letter dated 21.01.1993 (RBE No. 14/1993) referred to, ibid, as modified by their letter No.E(D&A)95 RG6-65, dated 17.01.1996 (RBE No. 07/1996).
