RBE No. 16/2005: Railway Services (Commutation of Pension) Rules

Sub: The Railway Services (Commutation of Pension) (Amendment) Rules, 2005.

S.O.- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Railway Services (Commutation of Pension) Rules, 1993, namely:-

1.     (1)   These rules may be called The Railway Services (Commutation of Pension) (Amendment) Rules, 2005.

(2)   Rule 5 shall be deemed to have come into force from the 19th day of July, 1997 and the remaining provisions of these rules shall be deemed to have come into force from the 1^st day of January, 1996.

2.     In rule 6 of the Railway Services (Commutation of Pension) Rules, 1993 (hereinafter referred to as the said rules),-

(i)    in sub-rule (1) for the words “a fraction not exceeding one-third”, the words “of an amount not exceeding forty per cent” shall be substituted;

(ii)    in sub-rule (2),-

(a) for the words “fraction of pension”, the words “per cent of pension” shall be substituted,

(b) for the words “one-third of pension”, the words “forty per cent of pension” shall be substituted;

(iii)   in sub-rule (3), for the words “fraction of pension”, the words “per cent of pension” shall be substituted.

3.     In rule 10 of the said rules, in sub-rule (3), in clauses (i) and (ii), for the words “one hundred rupees”, wherever they occur, the words “two thousand rupees” shall be substituted;

4.     In rule 11 of the said rules, in the proviso, for the words “one hundred rupees”, wherever they occur, the word “two thousand rupees” shall be substituted.

5.     In rule 19 of the said rules, clause (ii) shall be omitted;

6.     In rule 23 of the said rules, in sub-rule (1), in clause (b), for the words “one hundred rupees”, the words “two thousand rupees” shall be substituted;

7.     In Form 1 of the said rules, in Part 1, in asterisk “*” appearing after “Note”, for the brackets and words “(subject to maximum of one third thereof)” the following brackets and words shall be substituted, namely:-

“(subject to a maximum of forty per cent thereof)”

8.     In Form 2 of the said rules, in Part I, in asterisk “*” appearing after “Date”, for the brackets and words “(subject to a maximum of one-third thereof)” the following brackets and words shall be substituted, namely:-

“(subject to a maximum of forty per cent thereof)”.
