Reference is invited to Board’s circular of even number dated 17.04.2007 (RBE No. 60/2007) on the above subject enclosing Department of Personnel & Training’s Office Memorandum No.16/6/2001-Ess(Pay) I, dated 14.02.2006. DOP&T vide their Office Memorandum dated 04.01.2007, issued further clarification deleting para 5 of their Office Memorandum dated 14.02.2006, a copy of which is forwarded for information and guidance.

OFFICE MEMORANDUM

Sub: fixation of pay in case of employees who seek transfer to a lower post under FR 15(a) – clarification regarding.

In partial modification of this Department’s OM of even number dated 14.02.2006 on the subject above it has been decided that para 5 of the said OM which inter-alia lays down that “These orders take effect from the date of this O.M. is issued. Past cases already decided need not be reopened.”, shall stand deleted.
