RBE No. 14/2006: Ex-gratia – Payment to Families

Sub: Payment of ex-gratia compensation to families of Railway servants who die in performance of their bonafide official duties instruction regarding.

1. Scheme regarding payment of Ex-gratia compensation to families of Railway servants who die in performance of their bona fide official duties was introduced vide Board’s letter No.E(W)99/CP-1/1, dated 05.11.1999 (RBE No. 285/1999). The scheme is however effective from 01.08.1997.
2. Further instructions in the matter regarding applicability of the scheme to RPF personal and the Railway servants covered under the Workmen’s Compensation Act were issued vide Board’s letter No.E(W)99/CP-1/1, dated 09.02.2000. In case of WCA, however, the net amount of Ex-gratia compensation is to be determined after reducing the compensation payable under WCA from the amount of Ex-gratia compensation admissible.
3. Railways were further advised vide letter No.E(W)2000/CP-1/4, dated 06.12.2000 that the documents, viz. (i) FIR, (ii) Death Certificate, (iii) Postmortem Certificate; and (iv) FA&CAO’s concurrence are pre-requisite and should form part of Ex-gratia compensation proposals send to the Board for approval.
4. It has also been emphasized time and again that the cases should be urgently processed and Railways should send proposals to the Board within three months of death of the concerned employee(s). Due care should be taken to ensure that the cases should satisfy the conditions detailed in the scheme. In case of doubt, however, Board should be approached for clarification.
5. General Managers were advised vide Board’s DO letter No.E(W)2005/CP-1/27, dated 19.09.2005 that the proposals should have personal approval of the GM and FA&CAO.
6. Board desires that compliance of the above may please be insured by all concerned.
