RBE No. 137/1995: Appointment on Compassionate Grounds – Near Relatives

Sub: Appointment on Compassionate Grounds – Near Relatives.
1. Attention is invited to Board’s letter No.E(NG)III/78/RC-1/1, dated 25.08.1980 and letters of even number dated 12.02.1990 (RBE No. 28/1990) and 16.05.1991 (RBE No. 102/1991), regarding appointment on compassionate grounds of a ‘near relative’ of a Railway employee dying in harness subject to the conditions stipulated therein.
2. The Ministry of Personnel, Public Grievances & Pensions (Department of Personnel & Training), vide their Office Memorandum No.14014/20/90-Estt.(D), dated 09.12.1993, have deleted the provision of appointment of near relative on compassionate grounds. The instructions of 09.12.1993 have been issued by the DoP&T in order to implement the decision of the Hon’able Supreme Court in the case of Auditor General of India and Others vs. Shri Ananta Rajeshwara Rao.
3. The matter has been examined by the Board who have decided that the DOP&T’s instructions dated 09.12.1993 quoted above, may be adopted on the Railways. With the issue of this letter the provision for appointment of near relative on compassionate grounds on the Railways, contained in Board’s letter No.E(NG)III/78/RC-1/1, dated 25.08.1980 and letters of even number dated 12.02.1990 (RBE No. 28/1990) and 16.05.1991 (RBE No. 102/1991), as also in Part-III of the Master Circular No.16 may be treated as deleted.
