RBE No. 120/1999: Additional Increments – To Stock Verifiers

Sub: Granting D.A. etc. on three additional increments granted to Stock Verifiers on qualifying Appendix-IV(A) (IREM) Exam. – Clarification.
1. Please refer to this Ministry’s letter of even number dated 08.05.1996 (RBE No. 43/1996) on the above mentioned subject.
2. On the question of grant of D.A. etc. or otherwise on the three additional increments granted to the Stock Verifiers on qualifying the Appendix-IVA Exam., a few CAT cases/ Writ Petitions in High Courts have been filed by Stock Verifiers on various Zonal Railways. Keeping in view the judgments/ observations in these cases, Board have carefully examined the matter and has decided that:-
(i) Payment of D.A. etc. on three additional increments granted to Accounts Stock Verifiers for qualifying in Appendix-IVA examination, f so made, be immediately stopped except where a specific stay has been granted by any Court of Law.
(ii) Any excess payment, if so made, subsequent to 08.05.1996 should be recovered except where any specific order to the contrary has been issued by any Court of Law.
(iii) That D.A. and pension, wherever paid to the Stock Verifiers on these additional increments from 01.01.1986 to 08.05.1996 for passing the Appendix-IVA examination, should not be recovered. However, the amounts, if any, paid by the Railways to the employee after 08.05.1996 towards D.A. on these additional increments as well as by way of pension (taking into account these additional increments as part of Basic Pay) should be recovered. The pension of the persons in such cases should also be revised taking the same as on account of detection of a clerical error in terms of Rule 90 of Railway Services (Pension) Rules, 1993.
3. Board further desire that while past cases decided otherwise by individual Railway Administration on the subject for the period upto 08.05.1996 should not be reopened, it should be ensured that if there are any individual petitions/ Writ Petition, Appeals pending in any Court of Law to which Railway Administration is a party, stay order granted in these cases should be honoured in respect of individuals concerned notwithstanding the clarifications/ instructions contained in this letter so as to avoid any Contempt of Court.
4. It is reiterated that consequent upon the introduction of Fourth Pay Commission’s scale of pay, the additional increments granted to Stock Verifiers on their qualifying in Appendix-IVA examination do not form a part of the Basic Pay.
5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
6. Action taken in this regard may please be advised to Board’s office immediately.
