Sub: Settlement of pension and death-cum-retirement gratuity of Railway servants retired on or after 01.01.1996 while on EOL.

The matter regarding emoluments and average emoluments to be reckoned for calculating pension and death-cum-retirement gratuity of the Railway servants who were on leave without pay on and after 01.01.1996 till the date of retirement and thereby could not exercise their option to come over to the revised scales of pay introduced from 01.01.1996, has been under examination in this Ministry in consultation with the Department of Pension and Pensioners’ Welfare and the Department of Expenditure. It is clarified that prior to 01.01.1996, 4th Central Pay Commission (4th CPC) pay scales were in existence, hence pensionary benefits of the Railway servants, who were absent on extra-ordinary leave, i.e. leave without pay on or after 01.01.1996 till the date of retirement, can only be with reference to the 4th CPC pay scales. As such, the pension and death-cum-retirement gratuity of these retired Railway servants will have to be regulated in accordance with the provisions contained in Paras 10 and 11 of Board’s letter No.F(E)III/97/PN1/22, dated 05.11.1997 (RBE No. 142/1997), as modified from time to time.
