(ii) Hon’ble High Court of ALD’s order dated 18.04.2014 in Writ Petition No.20401/2014 (Title Shri Ram Badan Yadav vs. UOI and another).
(iii) Speaking Order No.2014-E(SCT)I/71/4, dated 04.08.2014 w.r.t. representation dated 18.05.2014 and 08.07.2014 w.r.t. (i) above.
(iv) Board’s letter No.2014-E(SCT)I/71/4, dated 04.08.2014 to CEC/AIOBCREF.
1. Attention is invited to Para 2(i) of Board’s letter No.2012-E(SCT)I/71/11, dated 10.01.2014 wherein it has been laid down that the list of elected office bearers of All India OBC Railway Employees Association of Zonal Railways/ PUs affiliated with CEC/AIOBCREF should be circulated duly approved and under joint signature by the President and General Secretary of the CEC of AIOBCREF for circulation by the Railway administration as done in case of SC/ST Association vide Board’s letter dated 16.06.1991 and 10.01.1995.
2. In view of the implementation of Hon’ble High Court/ALD’s order dated 18.04.2014 in case No.20401/2014 in the matter of Ram Badan Yadav vs. Union Of India and another, necessary speaking order dated 04.08.2014 passed and accordingly vide Board’s letter dated 04.08.2014, CEC/AIOBCREF was advised for taking necessary action for necessary amendment in the Bye-laws of AIOBCREF for incorporating the above provision as contained in Board’s letter No.2012-E(SCT)I/71/11, dated 10.01.2014 but the Federation has failed to incorporate the above provision in the Constitution/ Bye-laws of CEC/AIOBCREF till date as per the record of this office.
3. In view of the above, on review it has been decided by this office that operation of said Board’s letter dated 10.01.2014 under reference may be kept in abeyance till further orders.
This may please be brought to the notice of all concerned for necessary action.
