Sub: Regulation of MACPS in cases of promotion taking place in the pre-revised pay structure between 01-01-2006 and the date of notification of CCS (RP) Rules, 2008 and the subsequent merger of the pre-revised pay scales of the promotional and the feeder posts in a common Grade.
Ref: Railway Board’s letter dated 08.04.2016 (RBE No.33/2016).
1. References have been received in Board’s office from a few Railways, seeking clarification on the above mentioned subject. The issue has been examined in consultation with DoP&T, the nodal department of the Government on MACPS. It has been observed that in terms of Board’s letter dated 08.04.2016 (RBE No.33/2016), the promotion earned by employee, even though in the same Grade Pay as both the feeder grade and promotional grade are in the same Grade Pay, entails the benefit of pay fixation under Rule 13 of RS(RP) Rules, 2008. Thus, it cannot be said that the employee has stagnated in a particular grade for 10 years or more in order to be eligible for financial upgradation under MACP Scheme. Therefore, the promotion earned to the higher grade with the same Grade Pay shall count as an offset for determining, his eligibility for financial upgradation under MACP Scheme. Accordingly, the next financial upgradation under MACPS would become due only if the employee stagnates in that promotional grade for 10 or more years or has also rendered overall regular service of 20/30 years, subject to fulfillment of other eligibility conditions prescribed under MACPS for further financial upgradation.
2. Further, the promotion allowed after 01.01.2006 but before notification to grade which now fall in the same Grade Pay shall not be ignored for the purpose of determining MACP entitlement in terms of Para 8.1 of Annexure-I to Railway Board’s letter No.PC-V/2009/ACP/2, dated 10.06.2009 (RBE No.101/2009).
3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

it shows lethergic and irrospihnsible atttitude of dopt and railway board after one and half decade , releasing such orders without studying innocent employees fate at the fag end of service, due to which , retiring employees are loosing pension and payement of wrong ful recovery over payments .this increment was not asked by the emolyeesat the time of merging of scales, dopt and board has allowed increment .after one and half decade reducin gp is unjustified.please correct th orders if not lot of court cases will be filed. necessaryorders are to issued without any delay
Mentioning 2008 pay fixation rules to the merged pay scales into one grade pay ordered prior to 31.08.2008, is in correct, as the promoted scale disappeared. The concerned in DoPT should go through and cancel orders.

Whether entitled for 3rd MACP or not. Please clarify.
