Leased Accommodation: RBE No.117/2022 – Staff Posted in N.F. Railway

Sub: Retention of leased accommodation at previous place of posting to Railway officers on their transfer to N.F. Railway.

Ref: (i)    Board’s  letter No.2017/LMB-II/4/3, dated 03.09.2019 (RBE No.146/2019).

        (ii)    Board’s letter No.E(G) 2008 QR1-9 pt, dated 14.10.2021 (RBE No.74/2021).

1. Reference is invited to Board’s letter dated 03.09.2019 vide which Railway officers, on their transfer and posting to Northeast Frontier Railway (NFR), were permitted to retain leased accommodation at the place of their previous posting upto 30.06.2021 or till issue of revised orders on the subject, whichever is earlier, in line with MoHUA policy on retention.

2. It has now been decided by the competent authority to extend the facility of retention of ‘leased accommodation’ at previous place of posting to officers on transfer to N.F. Railway, at par with the retention of Railway accommodation, as conveyed vide Board’s letter under reference dated 14.10.2021 as retention policy of MoHUA for north east is still in place. This permission is subject to the following terms & conditions:-

(i)    Retention of ‘leased accommodation’ may be allowed at the previous place of posting up to 30.06.2024 or till issue of revised orders on the subject, whichever is earlier.

(ii)   Since the retention of ‘leased accommodation’ at the previous place in favour of officers who have been transferred and posted to NFR is allowed for bonafide use of the dependent family of transferred Railway officer, the officer will have to furnish certificate on 1st July and 1st January of every year that his dependent family is actually residing in the leased accommodation at the last station of his/her posting.

(iii)  The request from Railway officer for retention of ‘leased accommodation’ at the last station of his/her posting should be received within a period of one month from the date of relinquishing the charge at the last station of posting, so that further necessary action may be initiated by the controlling authority in time.

(iv)  A clause to the effect that as soon as some vacant Railway quarter as per the entitlement of the officer is offered, he/she will have to vacate the leased accommodation and the lease would be terminated immediately would be incorporated in the leased agreement itself.

4. This issues with the concurrence of Finance Directorate of the Ministry of Railways.
