Family Pension: RBE No.38/1988 – Temporary Government Servants

Sub: Grant of Family Pension to the families of temporary Government servants retired on superannuation on completion of 10 years temporary service.

1. In terms of this Ministry’s letter No.F(E)III/78/PN 1/13, dated 21.02.1981, a Railway servant who on his retirement from service on attaining the age of superannuation or on his  being declared to be permanently incapacitated for further Railway service by the appropriate medical authority after rendering temporary service of not  less  than 20 years is eligible for the grant of superannuation or invalid pension, death-cum-retirement gratuity and family pension in accordance with the Railway Pension Rules.

2. The said letter has further been modified vide this Ministry’s letter No.PC IV/87/Imp/PN/1, dated 15.04.1987  (RBE No.90/1987) providing for grant of superannuation/ invalid pension, retirement gratuity and family pension at the same scale as admissible to permanent employees under the Railway Pension Rules in respect of Railway employee who are/were in service on 01.01.1986 and who retire on superannuation or on being declared permanently incapacitated for further Railway service by the appropriate medical authority after having rendered temporary service of not less than 10 years.

3. The question regarding grant of family pension to the families of Railway employees who retired on   superannuation or on being declared permanently incapacitated for further Government service by the appropriate medical authority after having rendered not less than 10 years temporary service before 01.01.1986 has been under consideration of the Government for sometime past. The President is pleaded to decide that the family of a Railway servant who retired on superannuation or on being declared permanently incapacitated for further Railway service by the appropriate medical authority after having rendered temporary service of not less than 10 years prior to 01.01.1986 will also be eligible to family pension under the Railway Pension Rules, at the same scale as admissible to the family of a permanent employee from time to time.

4. The provisions of this letter shall apply to those temporary Govt. servants who retired before 01.01.1986. The benefit will be available to the widows from 14.01.1988.

5. The same procedure as provided for in Chapter VII and VIII of Manual of Railway Pension Rules, 1950 and as amended from time to time will be followed mutatis mutandis for grant of Family Pension under this letter.

6. Formal amendment to the Indian Railway Establishment Code Volume II and MRPR 1950 will be issued in due course.
