Sub: Absorption in RITES & IRCON.

Dear Sir,

1. In supersession of the instructions contained in their letter of even number dated 30.11.1984 on the subject, the Department of Railways (Railway Board) have now decided that with immediate effect the policy regarding deputation to and permanent absorption in RITES and IRCON of railway servants, would be governed by the policy enunciated in Bureau of Public Enterprises’ letter No.5(25)/83-BPE(PESB), dated 6th March, 1985 modified by the relaxation contained in BPE’s letter No.5(25)/85-BPE (PESB), dated 28th August, 1985 and Department of Personnel’s letter No.36(37)E.O./84(SN), dated 01.10.1985 (Copies enclosed).

2. Within the framework of the above policy of the Government, RITES and IRCON shall evolve internal norms regarding the numbers of permanent aborbees and deputationists with the approval of their respective Boards of Directors and shall advise the norms so evolved to the Department of Railways (Railway Board). When doing so, RITES and IRCON will doubtless give due consideration to various, and somewhat conflicting, considerations like the need for a hard core of permanent employees in the Organisation for the sake of continuity, the need for minimising temporary surpluses in staff due to fluctuations in business; the need for protecting the long-term career prospects of the Permanent absorbees, etc. Individual proposals for absorption should be sent by RITES/ IRCON to the Department of Railways only after clearance by the Board of Directors. Each such proposal should inter-alia specifically indicate whether it is in keeping with the internal norms so set up by them and if not, special reasons for deviation therefrom.

Sub: Deputation of Government Officers to Central Public Enterprises – Review of policy.

1.     The undersigned is directed to refer to the marginally noted (above) Office Memoranda of this Ministry and to say that the Government have reviewed the policy regarding deputation of Government officers to Central public enterprises in the context of the need for toning up the performance of public enterprises.

2.     In supersession of all extant orders on the subject, it has been decided that deputation of all Government officers, including those belonging to Defence Services, to all posts (whether Board-level or below Board-level) in central Public enterprises should, except in the cases mentioned in the following paragraph, not be permitted from the date of issue of this O.M. Hereafter; such officers could join posts in the Central public enterprises only on immediate absorption basis.

3.     (i)    However, deputation may be permitted for a maximum period of three years in the case of Chief Executives and regional/ zonal chiefs of Central public enterprises who require continuous liaison and co-ordination with State Governments and where expertise acquired in the State Government is needed for organizational efficiency. Following are the examples of enterprises coming under this category:

(a) Central Cottage Industries Corporation,

(b) Central Inland Water Transport Corporation,

(c) Central Warehousing Corporation,

(d) Cotton Corporation of India,

(e) Food Corporation of India,

(f) Handicrafts & Handlooms Export Corporation Ltd.

(g) National Handloom Development Corporation,

(h) National Seeds Corporation,

(i) Rehabilitation Industries Corporation,

(j) Rural Electrification Corporation

(k) State Farms Corporation

(l) Trade Fair Authority of India.

(ii)    Deputation may also be permitted in the case of Chief Vigilance Officers in all Central public enterprises; the tenure of officers of Organised Services appointed to posts of Chief Vigilance Officers in public sector undertakings should be the same as the tenure that would be permissible in their cases on their deputation to the centre.

4.     The policy that Government employees joining public sector undertakings can do so only on ‘immediate absorption’ basis will also apply to employees of one public sector undertaking joining other public sector undertakings, regardless of the level of the posts involved.

5.     In respect of officers who are already on deputation to Central public enterprises, the existing terms and conditions of their deputation will operate. However, no extension of deputation beyond the periods specified in their deputation orders should be allowed.

6.     The Administrative Ministries and the various cadre authorities are requested to take necessary steps to implement these decisions.

1. Please refer to Ministry of Railways’ memorandum No.85/E(O)II/4/26, dated July 1, 1985 regarding deputation of railway personnel to RITES and IRCON.

3. The Appointments Committee of the Cabinet have approved the proposal to exempt RITES & IRCON from the rule of immediate absorption for a period of five years to take officers on deputation from their parent cadre. Further action may kindly be taken in the light of the above decision of the ACC.

1. Reference D.O. letter No.36(37)EO/84 (SM), dated 29th August, 1985 from the Ministry of Railways (Railway Board) regarding exemption of RITES and IRCON from the rule of immediate absorption.

2. The Appointments Committee of the Cabinet have already approved the exemption of RITES and IRCON from the rule of immediate absorption for a period of 5 years to take officers on deputation only from their parent cadre. The intention is that the deputation of Railway officers to RITES and IRCON would be on a project linked basis. The initial deputation would be for a period of 2 years and depending on the nature and duration of the project, the deputation period could be extended thereafter (beyond the initial 2 years) on a year to year basis, subject to a maximum of five years.
