RBE No. 176/2006: Railway Accommodation – Retention

Sub: Retention of Railway accommodation in the event of deputation to PSUs, Central Ministries, etc.
Railway Board in their meeting held on 18.10.2006 considered/ reviewed the instructions regarding retention of Railway accommodation at the previous place of posting by Railway employees proceeding on deputation to Railway PSUs, Central Ministries and other eligible offices for allotment of accommodation by Directorate of Estate, Ministry of Urban Development, retention of non-pooled accommodation in the event of retirement and also definition of academic year/ scholastic year in respect of retention of Railway accommodation. The following decisions have been taken and the relevant cases may be regulated accordingly.
(1) Retention of Railway accommodation at the previous place of posting permitted in relaxation of the instructions contained in Board’s letter No.E(G)2000 QR 1-23, dated 01.06.2001 (RBE No. 100/2001) in favour of Railway employees on deputation to MRVC, IRCTC, KRCL and Rail Tel has been extended upto 31.03.2009 or construction of accommodation which has been/is being undertaken by the Railways for PSUs, whichever is earlier.
(2) The deputationist Railway employees to CRIS, RVNL and RLDA will continue to retain the Railway accommodation at the previous place of posting.
(3) The deputationist Railway employees to Dedicated Freight Corridor Corporation of India Ltd. (DFCCIL) and other SPVs may be allowed to retain the Railway accommodation at the previous place of posting for a maximum period of five years from the date of setting up of the SPVs or till the completion of construction of accommodation, whichever is earlier.
(4) The deputationist Railway employees to IRCON and RITES will continue to be governed by the instructions contained in para-4 of letter No.E(G)2000 QR 1-23, dated 01.06.2001 (RBE No. 100/2001).
(4.1) Railway employees on special assignment to RITES or IRCON exclusively for Railway works only will, however, be allowed retention of Railway accommodation at the previous place of posting for a period of one year at a time and upto a maximum period of two years only.
(4.2) The special relaxation made in favour of those Railway employees, who are on deputation to IRCON exclusively for Udhampur-Srinagar-Baramulla Rail Link Project and posted at the site of the project for the entire period of their posting there, would continue.
(5) The rent chargeable towards retention of Railway accommodation permitted to Railway employees on deputation to PSUs are contained in paras 2 & 3 of letter No.E(G)2000 QR 1-23, dated 01.06.2001 (RBE No. 100/2001). In supersession of these instructions, it has been decided that in cases where Railway employees on deputation to PSUs are allowed to retain Railway accommodation at the previous place of posting, the concerned PSU/ Organization should credit to the concerned Railway unit, the amount equivalent to the entitlement for the leased accommodation of the Railway employee availing the retention facility.
(6) Instructions relating to grant of permission for retention of Railway accommodation in favour of Railway employees on deputation to Central Ministries/ Departments under Central Staffing Scheme and to other Organizations eligible for allotment of accommodation from General Pool by Directorate of Estates have been reviewed. Keeping in view the shortage of Railway accommodation and the fact that deputation is voluntary on the part of Railway employees, it has been decided in supersession of para-4 of instructions contained in letter No.E(G)2000 QR 1-23, dated 01.06.2001 (RBE No. 100/2001), 14.02.2002 (RBE No. 19/2002), and letter No.E(G)2003 QR 1-19, dated 19.04.2004 (RBE No. 87/2004) that Railway employees going on such deputations, excluding the Group A&B Railway officers appointed in the personal staff of President, Prime Minister and Ministers in Central Government, should be treated at par with normal permanent transfer and the instructions governing retention of Railway quarter in the case of permanent transfer (Para-1 of letter No.E(G)2000 QR 1-23, dated 01.06.2001(RBE No. 100/2001) shall apply in their cases. Thus, new instructions would be applicable to officers proceeding on deputation on or after the date of issue of this letter. In respect of Group A&B Railway officers appointed in the personal staff of President, Prime Minister and Ministers in Central Govt. instructions contained in letter No.E(G)2003 QR 1-19, dated 02.09.2005 (RBE No. 145/2005) shall continue to govern retention of quarter.
(7) Retention of non-pooled Railway accommodation in the event of transfer, retirement etc. is governed by instructions contained in letter No.E(G)2001 RN 4-10, dated 17.09.2002 (RBE No. 164/2002). In partial modification of these instructions, it has been decided that the Railway employees in occupation of non-pooled Railway accommodation at the time of their retirement may be allowed retention of the non-pooled accommodation under their occupation for a period of two months only. In the event the concerned retired Railway employee so desires to further retain Railway accommodation, on request, an alternative Railway accommodation of his/her entitled category may be allotted at the place of his choice anywhere in India, subject to availability, for the remaining period of six months, on payment of usual rent, as charged in the case of retention of accommodation on retirement under the extant instruction (Para-5 of letter No.E(G)2000 QR 1-23, dated 01.06.2001 (RBE No. 100/2001).
(8) Retention of Railway accommodation in the event of permanent transfer is permitted on educational grounds to cover the current academic session. The ‘academic/scholastic session’ has been defined as the academic course ending with annual examination. This aspect has been reviewed and in partial modification of instructions contained in letter No.E(G)85 QR 1-9, dated 15.01.1990 (RBE No. 08/1990), it has been decided that for the purpose of retention of Railway accommodatio n, the end of academic/ scholastic session shall mean ‘last paper of annual examination plus fifteen days time’.
This issues with the concurrence of Finance Directorate of Ministry of Railways.
