RBE No. 51/1985: Hour of Employment Regulation – HOER – Supervisory Staff

Sub: Revision of the list of Supervisory Staff under the Hours of Employment Regulations – Case of Loco Forman ‘C’/ Loco Forman ‘B’ working in shifts in sheds in Gr. Rs.550-750 (RS).
Ref: The Ministry of Railway’s letter No.E(LL)70/HER/16, dated the 4th January, 1972 on the above subject.

1. A doubt has been raised weather Loco Forman ‘C’/ Loco Forman ‘B’ Gr. Rs.550-750 (RS) who are in-charge in Loco Sheds and not employed in shift duty should only be treated as supervisory, the rest working in shift duties round the clock under a main supervisor, should be treated as “non-supervisory” under the Hours of Employment Regulations.
2. The matter has been examined and it is clarified that if the nature of duties of the employees is supervisory then they have to be treated as “supervisory”, irrespective of the fact of their employment in shift duty or otherwise.
3. Past cases dealt with otherwise need not be reopened.
