RBE No. 142/1985: Retention of Railway Accommodation – Deputation

Sub: Retention of railway accommodation by employees on occurrence of various events deputation and secondments in India.

1. Please refer to the comprehensive instructions issued under this Ministry’s circular letter of even number dated 17.12.1983, read with para 2(iii) of their letter of same number dated 27.08.1984 (re-produced below for ready reference):

“2(iii) Deputation and secondment in India (item 3 and 4 of annexure to Board’s circular, ibid, refer); it has been decided to treat secondment and deputation in India including with RITES, IRCON on the same lines as for permanent transfer. However, the employee who proceed on secondment or deputation to RITES, IRCON will pay market rent for the permissible period beyond the period of first two months. This relaxation in the case of RITES and IRCON will be valid for a period of 2 years from the date of issue this letter.”

2. The question of retention of railway accommodation by employees in cases of deputation and secondment in India including deputation to other Ministries/ Departments of the Central or State Government and Public Sector Undertakings including RITES and IRCON has been reviewed by the Ministry of Railways in partial modification of the instructions contained in their aforementioned letter, they decided that in cases of deputation and secondments in India including deputation to other Ministries/ Departments of Central or State Government and Public Sector Undertakings including RITES and IRCON, the employees would be allowed retention of railway accommodation for a period of 2 months only on normal rent and they cannot retain the railway accommodation beyond this specified period of 2 months on any grounds whatsoever even on payment of double the assessed/ market rent, etc. Rent of the orders contained in Board’s letters quoted above remain unchanged.
3. These orders will come into force from the date of issue of this circular and are issued with the concurrence of the Finance Directorate of the Ministry of Railways and have the approval of the President. Past cases already settled otherwise in accordance with the existing orders referred in Para 1, ibid need not be reopened.
4. Ministry of Railways would also like to emphasize that benefit of retention of railway accommodation by employees on occurrence of various events should be allowed only to the extent permissible under the rules/ extent instructions and that no special case should be made out for any relaxations.
