Transfer: RBE No.35/2003 – Ticket-Checking Staff

Sub: Transfer/ Re-transfer of Ticket-Checking staff – Creation of new Zones.

1. In the PNM-NFIR meeting held on 02-03.12.2002, the General Secretary, NFIR pointed out, in the context of creation of new Zones, that Ticket-Checking staff who were transferred on inter-divisional basis should be transferred back to the parent Railway if the Division in which they are working becomes part of the new Zonal Railway.

2. In terms of existing instructions, a Ticket-Checking staff who is transferred from one seniority unit to another seniority unit (inter-divisional/ inter-zonal transfers) on grounds of suspected malpractices and in whose case the disciplinary proceedings fail to prove any charge thereby exonerating the employee fully, may be transferred back to the original seniority unit on review of his case by GM on his request, without any loss of seniority. Similarly, in the cases of those Ticket Checking staff in whose case a penalty of “censure” has been awarded on finalisation of DAR case, GM may review the cases of such staff on their request for being transferred back to the original seniority unit. However, no transfer allowance is admissible in both these types of cases. The review will be done by the General Manager personally and these powers will not be delegated further.

3. The matter raised by the Federation has been carefully considered by the Board. It has been decided that it is not possible to accede to their request to cover the cases of employees who are awarded a penalty higher than “censure” on finalisation of the disciplinary proceedings; the extant instructions as enumerated in para 2 above providing for review on request of employees in cases when they are fully exonerated or awarded only a penalty of “censure”.

4. It may, however, to be ensured that from now onwards till the new Zones become operational w.e.f. 01.04.2003, while transferring employees on grounds of suspected malpractices, the jurisdiction of the new Zones (after bifurcation) and the parent Zones should be kept in view while deciding the unit to which the employees are to be transferred to.
