RBE No. 91/2006: Appointment on Compassionate Grounds – To Adopted Sons/ Daughters

Sub: Appointment of adopted sons/ daughters on compassionate grounds.

1. Attention is invited to Ministry of Railways (Railway Board’s) letter No.E(NG)II/86/RC-1/1/Policy, dated 20.05.1988 (RBE No. 106/1988), regarding appointment of adopted sons/ daughters on compassionate grounds.
2. A demand has been tabled by the staff side in the PNM/AIRF (Item No.15/06) regarding the anomaly created due to stipulation made in para 3 of Board’s letter, ibid.
3. The matter has been considered and it has been decided that para 3 of Board’s letter, ibid, be substituted by Section 11 of the ‘Hindu Adoption and Maintenance Act, 1956’. Further, while examining the question regarding validity of adoption, Railways/ PUs are to take into consideration the other related provisions of the Act, such as those contained in Section 10 imposing certain restrictions on the adoption.
