RBE No. 85/1989: Fixation of Pay – Merged Scales

Sub: Fixation of pay under Note (i) below Rule 7(1) of RS(RP) Rules, 1986.
1. Reference ‘Note (1)’ below Rule 7(I) of the Railway Services (Revised Pay) Rules, 1986 which provides that where a Railway servant is holding a permanent post and is officiating in a higher post on a regular basis and the scales applicable to these two posts are merged into one scale, the pay shall be fixed under this sub-rule with reference to the officiating post only and the pay so fixed shall be treated as substantive pay. There had been some cases of Railway servants who were officiating in a higher post prior to 1st January, 1986 on Ad hoc basis and the scales of these two posts are revised into one scale with effect from 01.01.1986. It has been represented that the benefit of ‘Note (1)’ below Rule 7(I) may be made applicable in such cases also.
The matter has been considered. Note (1) below Rule 7(I) is not at present applicable in such cases of appointment on ad hoc basis. However, in those cases of ad hoc appointments on an officiating basis, where all the attributes of appointment on a regular basis are present and where regular appointments could not take place due to administrative delays, the benefit of fixation of pay envisaged in the aforesaid Note (1) below Rule 7(I) may be made applicable subject to the fulfillment of the following conditions:-
(i) The ad hoc appointment was made from a date prior to 01.01.1986 and continued in that capacity after 01.01.1986 also.
(ii) At the time of ad hoc appointment, the Railway servant should have rendered the minimum service in the lower grade which is prescribed as a basic eligibility criterion in the relevant recruitment rules for appointment to the higher grade.
(iii) The ad hoc appointment was made against a regular vacancy other than a leave vacancy and the appointment was made on the basis of seniority in the cadre subject to rejection of unfit.
2. Pending necessary amendments to the RS(RP) Rules, 1986, cases falling in the above category may be decided in accordance with the principles laid down in the preceding paragraph.
