Sub: Reiteration of instructions relating to application of own merit in Direct Recruitment for appointment of Other Backward Classes (OBCs) – regarding
Ref: Railway board’s letter No.95-E(SCT)I/49/5(I), dated 21.08.1997 (RBE No.113/1997)

The Hon’ble Supreme Court in its judgment in the case of R.K.Sabharwal Vs. State of Punjab, had, inter-alia, observed that “the reserved category candidates can compete for the non-reserved posts and in the event of their appointment to the state posts their number cannot be added and take into consideration for working out the percentage of reservation.”
In this regard attention is invited to Railway Board’s letter No.95-E(SCT)I/49/5(I), dated 21.08.1997 (RBE No.113/1997) wherein it has been mentioned that persons belonging to reserved categories, who are appointed on the basis of merit and not on account of reservation are not to be counted towards the Reserve quota.
It has been brought to the notice of Railway Board by the Department of Personnel and Training (DOP&T) that above instructions are not being followed in some cases in direct recruitment to Central Government jobs and services. It is therefore, re-iterated that while making Direct Recruitments, guidelines issued vide Railway Board’s letter No.95-E(SCT)I/49/5(I), dated 21.08.1997 (RBE No.113/1997) may be kept in view by the concerned Railways/ PUs.
The above may be brought to the notice of all concerned for information and strict compliance.
